Consistent with the staff report recommendation regarding costs associated with the event, staff has revised the event's conditions of approval, which were carried over from last year's event. Attached are revised conditions of approval showing the items being removed. Attachments: 1. Revised conditions of approval for Temporary Use Permit 14-017 GENERAL CONDITIONS: EXHIBIT "A" CONDITIONS OF APPROVAL FOR TEMPORARY USE PERMIT NO. 14-017 THE VILLAGE CHRISTMAS PARADE 1. This Temporary Use Permit (TUP) allows Doc Burnstein's Ice Cream Lab and the Arroyo Grande Village Improvement Association to conduct the 1Oth annual Christmas Parade in the Village on November 30, 2014 between 5:00 pm and 6:QO pm, along with all associated street closures. 2. The appl_icant shall ascertain and comply with all State, ·County and City requirements as are applicable to this project. 3. The event shall occur in substantial conformance with the application and plans on file in the Community Development Department. 4. The applicant shall comply with all of the Conditions of Approval for Temporary Use Permit 14-017. 5. The applicant shall agree to indemnify and defend at his/her sole expense any action brought against the City, its agents, officers, or employees because of the issuance of said approval, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fees which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. 6. The applicant shall notify all affected businesses and residents of street closures and parking restrictions at least 48 hours prior to the event. 7. The applicant shall abide by all road closure and parade regulations as established by the Police Department. 8. The applicant shall pay for half of the actual City cost to ensure public safety, establish no parking zones, close streets and to provide for t\No police officers. Applicant costs are estimated to be $647. 9. The applicant shall comply with the Health Department regulations for all food products provided or sold during the event. 10. The applicant shall post "No Parking" signs 48 hours in advance of the street closures. My mother, Marsha, and I are the owners of Ralph & Duane's in the Village of Arroyo Grande. We have owned this business for 13 years now and are looking forward to continuing to do so for many years. to come. We have been reading about the complaints published recently in The Tribune and The Coast News and would like to address these concerns with you personally and to share our point of view. At Ralph & Duane's, we understand and comply with the unwritten law limiting noise after 10:00pm. Admittedly, we did push this once last year when we attempted to having live music in our outdoor patio the first Friday every month. We tried this out twice to add entertainment value for our customers, not thinking that it would cause any concern, but we received numerous complaints from the neighbors. After realizing that the noise was too intrusive to area residents we immediately retired the idea. Since then, we have returned to our normal entertainment schedule which consists of a OJ, inside the bar, Thursdays-Saturdays; 9:00pm-1:30am and live music on the patio Sundays, May-October, 2:00-G:OOpr:n. The bUlk of our business is from .i1:00pm to 1:30am. (Our last call is at 1:30am; and we close our doors at 2:00am.) It fs the-nightlife crowd we have worked cin for a long time to build up.' I realize this is not the most glamorous business in the Village but we do offer a service that others cannot: a place for adults to come arid socialize. We offer entertainment, a welcoming staff, delicious barbecue (on · occasions), all in a safe and comfortable environment. Of course, sometimes, the occasional person will leave here and be loud or reckless. We take all precaution to prevent this while they are in our establishment, but we don't have control of what they do after they leave.* We work with the Arroyo Grande Police Department regularly to try to make sure to create as safe of an environment as possible for everyone. We have a wide range of clientele. Most are local regulars. They range in age from 21 to late 80's. Most of the older day clientele are retired. The customers in their mid 20's to SO's are the blue collar working class coming in after a hard day's work. Late at night we have the youngest crowd, ages 21-40, who come to enjoy our nightlife. · The building was originally established many decades ago, intentioned to be a bar. In fact, it was built so much with this in mind that it would be extremely difficult to use the building for any other business. It has a rich history and is looked upon by locals with fond no~talgia. Many of our customers tell us stories of their parents and grandparents having been past customers. In the l3years that we have had the business, we have significantly improved its profitability. Our current landlord had run the family business prior to our ownership, but had grown tired of doing so. He decided so to sell entrusting us with his name which still graces our door today. We have brought a lot to this area and will continue to do so. We advertise often in Fresno and Bakersfield knowing that this area is an attraction for them. We have had many customers come in response to these ads who in turn also visit neighboring stores and restaurants and stay in area hotels. We have had a lot of return business from these areas which also benefits the Village as a whole. In addition to out of area advertising, we also promote locally on the radio and in The Coast News, attracting our neighbors in Santa Maria, Nipomo, Five Cities and San Luis Obispo. Another way we support our community is by hosting numerous fundraisers and benefits throughout the year helping neighbors in need. Should we be forced to close our doors at 10:00pm, this would devastate our business along with making it uncomfortable for our customers. Our customers would be forced to take their business elsewhere. Since we are one of two businesses in Arroyo Grande outside of the Village, this means these locals would then go to Grover Beach, Pismo Beach or San Luis Obispo. We've become a part of the rich history tied to business establishment and community. Our heart is here in the Village of Arroyo Grande. We take a lot of pride in the business that we have built, the environment that we have created and the history we have honored. Safety and wellbeing of our customers and our community is very important to us. Furthermore, we feel that our contribution to the community is significant. We are willing to work with the City, community and law enforcement in any way we can. However, we urge you end the entertainment of this ordinance that could cause ou·r business to close its doors at 10:00pm. *Occasionally our customers will be wondering the local streets after they leave because they can't get a ride. We try to provide taxi service to customers but the taxi companies don't like to come to the village because the money is in San Luis Obispo and it's out of their way. We certainly understand these circumstances, but it does make it more difficult. Often times our staff, including myself, have given rides home ourselves to help our customers and ensure their safety.
