R 4642 RESOLUTION NO. 4642 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE APPROVING PLOT PLAN REVIEW CASE NO. 12-009; A NEW PUBLIC RESTROOM FACILITY; HERITAGE SQUARE PARK WHEREAS, the South County Historical Society, in coordination with the Arroyo Grande Recreation Services and Public Works Departments, have proposed the development of a new public restroom facility at Heritage Square Park; and WHEREAS, the South County Historical Society and the City conduct events at Heritage Square Park that require public restroom facilities; and WHEREAS, the property is zoned Public Facilities in the D-2.4 Historic Character Overlay District; and WHEREAS, the property is currently developed as a public park; and WHEREAS, On March 12, 2013, the City Council approved the preferred location for the Heritage Square Park Restroom; and WHEREAS, Arroyo Grande Municipal Code Subsection 16.16.080.B.2 requires the approval of a Plot Plan Review for projects in the Historic Character Overlay District (D- 2.4); and WHEREAS, the construction of a public restroom facility on City owned property requires the approval of the City Council; and WHEREAS, on November 25, 2014, the City Council reviewed the project at a duly noticed public hearing; and WHEREAS, the City Council finds, after due study, deliberation and public hearing, the following circumstances exist: FINDINGS FOR APPROVAL 1. The proposed project is consistent with the goals, objectives, policies, and . programs, of the Arroyo Grande General Plan. The development of a restroom facility is permitted within the Public Facilities Zoning District if approved by a Plot Plan Review. 2. The proposed project conforms to applicable performance standards and will not be detrimental to the public health, safety or general welfare. The proposed restroom is located within an existing public park and is 4 adjacent to other public facilities. 3. The physical location or placement of the use on the site is compatible with the surrounding neighborhood. RESOLUTION NO. 4642 PAGE 2 The proposed restroom is in an existing developed public park and the design was reviewed by the City's Architectural Review Committee, . Historical Resources Committee, and Parks & Recreation Commission to ensure the restroom's architecture is compatible with the character of adjacent structures. 4. The construction, alteration, demolition, or relocation of any building or structure or earth movement enhances, to the maximum extent feasible, and does not interfere with, detract from or degrade the historic cultural, architectural or archaeological resource values of the district. The proposed restroom facility design is complementary to the existing bandstand structure in style and color, and meets the Design Guidelines and Standards for the Historic Character Overlay District (D-2.4). 5. The use proposed for a building, structure, or parcel of land shall be compatible with the uses pre-dominating the designated area. The proposed use of the new structure as a public restroom facility is compatible with the existing public facility uses at Heritage Square Park and is a permitted use in the Public Facilities Zoning District. 6. The development, demolitions, relocations, conversions are in keeping with the architectural style and scale characterizing the period of history in which the structure was built, including the landscaping features, and/or the features which caused the property to be so included in the district. The proposed restroom facility is designed to be compatible with nearby structures located inside and adjacent to Heritage Square Park. The architecture of the restroom was reviewed by the Architectural Review Committee and the Historical Resources Committee to ensure it meets the intent of the Historic Character Overlay District (D-2.4). 7. Proposed restoration efforts are in keeping with details, materials, textures, colors, and landscape features common to the period of history when the designated district was constructed. No restoration is proposed as part of the project. The project will, however, be designed to enhance the historic character of structures located inside and adjacent to Heritage Square Park and was reviewed by the Architectural Review Committee and Historic Resources Committee. 8. Where applicable, the project meets the alternative building regulations pursuant to Part 8 of Title 24 of the 2007 California Historical Building Code and the Secretary of the Interior's Standards for Historic Preservation Projects. The proposed restroom facility does not fall under the jurisdiction of the RESOLUTION NO. 4642 PAGE 3 California Historical Building Code nor under the Secretary of the Interior's Standards for Historic Preservation Projects. NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Arroyo Grande hereby approves the project design indicated in Exhibit "B" with the above findings and subject to the conditions of approval as set forth in Exhibit "A", attached hereto and incorporated herein by this reference. CAR , CI o RNEY RESOLUTION NO. 4642 PAGE 5 EXHIBIT "A" CONDITIONS OF APPROVAL PLOT PLAN REVIEW 12-009 HERITAGE SQUARE PARK RESTROOM CONDITIONS OF APPROVAL Planning Division 1. The applicant shall ascertain and comply with all Federal, State, County and City requirements as are applicable to this project. 2. The applicant shall comply with all conditions of approval for Plot Plan Review 12- 009. 3. The restroom shall be constructed in conformance with the site design on Exhibit "B" of this Resolution. 4. The applicant shall agree to defend at his/her sole expense any action brought against the City, its present or former agents, officers, or employees because of the issuance of said approval, or in anyway relating to the implementation thereof, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fees which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. 5. All lighting shall be shielded and directed downwards in accordance with the Municipal Code. Building Division and Fire Department 6. The project shall comply with the most recent editions of all California Building and Fire Codes, as adopted by the City of Arroyo Grande. 7. Provide complete compliance with the State and Federal Disability access requirements 8. A building permit shall be obtained by the installer/builder of the restroom structure. Engineering 9. The applicant shall be responsible during construction for cleaning city streets, curbs, gutters and sidewalks of dirt tracked from the project site. The flushing of dirt or debris to storm drain or sanitary sewer facilities shall not be permitted.
