RESOLUfION NO. 2968
A RESOLUfION OF TilE CITY COUNCIL OF TilE CITY OF
ARROYO GRANDE ACCEPTING TilE TRANSFER OF
APPLICANT STATUS FOR TWO NON-URBAN COUNTY
PROPOSITION 116 PROJECTS
WHEREAS. the San Luis Obispo Council of Governments (SLOCOG) approved the City
of Arroyo Grande's request for bicycle/pedestrian facilities near Paulding Middle School; and
WHEREAS, the SLOCOO approved the City's request for a bicycle/pedestrian facilities
near the Arroyo Grande High School and Margaret Harloe School; and
WHEREAS. the SLOCOG is the designated Regional Transportation PlaMing Agency
(RTPA) and eligIble applicant Identified in Proposition 116; and
WHEREAS, the SLOCOO desires to transfer their eligible applicant status for the pUfPOses
of these projects to the City of Arroyo Grande.
.0 N9W. THEREFORE, BE IT RESOLVED:
l. That the City of Arroyo Grande accepts the transfer of status and all management and
responsibilities of the projects.
2. That the City of Arroyo Grande as the applicant, certifies it has the .financial and
Institutional ability to accept the legal liabilities and obligations associated with the project.
3. The project is a part of an approved transportation plan and is consistent with the Regional
Transportation !tlan.
4. That the City of Arroyo Grande can encumber the funds within twenty four (24) months
following funding allocation.
S. The City of Arroyo Grande will construct and operate the projects in a manner that is fully
accessible to pedestrians and that the projects will be reasonably accessible to bicycle users.
On motion of Council Member Moots, seconded by Council Member Brandy, and by the
following roll call vote, to wit:
AYES: Council Members Moots, Brandy, Souza, Burke and Mayor Gallagher
