RESOLUTION NO. 2964
A RFSOLUTION OF THE CITY COUNCIL OF THE CITY
OF ARROYO GRANDE DENYING DEVEWPMENT CODE
REZONE NO. 92-224, APPUED FOR BY WASSILY VON
BlSKUPSKY
WHEREAS, the City Council of the City of Arroyo Grande has held a public hearing
on Development Code Rezone No. 92-224, applied for by Wassily Yon Biskupsky, to allow
common sewer laterals in air space condominiums;
- WHEREAS, a noticed public hearing was held by the City Council on January 12, 1993
at which time all interested persons were given the opportunity to be heard; and
WHEREAS, the City Council has reviewed and considered the information and public
testimony presented at the public hearing and in the staff report.
NOW, THEREFORE, BE IT RFSOLVED that the City Council hereby DENIFS
Development Code Amendment No. 92-224 based on the following findings:
1. T,he proposed revision to the Development Code will adversely affect public health
because it has the potential to allow sewer backup problems in living units.
2. The potential environmental impacts of the proposed revisions to the Development Code
are significant due to public health and safety issues.
On motion of Council Member Souza, seconded by Council Member Moots, and by the
following roll call vote, to wit:
AYFS: Council Members Souza, Moots, Brandy, Burke and Mayor Gallagher
NOFS: None
ABSENT: None
the foregoing Resolution was adopted this 12th day of January, 1993.
