RESOLUTION NO. 2944
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO
GRANDE DECLARING ITS INTENT TO HOLD A PUBLIC HEARING TO
ASCERTAIN WHETHER A PUBLIC NUISANCE EXISTS AT PROPERTY
LOCATED AT 515 NELSON STREET/ARROYO GRANDE CREEK, DANIEL
AND DENISE COZZA
WHEREAS, Daniel and Denise Cozza as owners of property located at 515 Nelson Street (APN 7-501-26),
are successors in interest to an illegal encroachment on adjoining City property; and
WHEREAS, the illegal encroachment consists of a timber deck which is structurally unsafe; and ..
_ WHEREAS, the illegal encroachment lies within the Arroyo Grande Creek flood channel and poses a
threat to flood flows; and
WHEREAS, members of the Public Works and Building staff have met with the owner of said property
regarding the illegal encroachment; and
WHEREAS, the owners have refused to remove the illegal encroachment;
NOW, THEREFORE, BE IT RESOLVED that the City Council does find, based on the recommendations
of the Director of Public Works, that a public nuisance may exist appurtenant to property commonly known
as 515 Nelson Street, Arroyo Grande (APN 7-501-26), being Parcel 2 of Parcel Map AG 72-324; and
BE IT FURTHER RESOLVED that in the event that a finding that a public nuisance does exist, it will
be the intent of the City Council to direct the Director of Public Works to perform or to employ a
competent general contractor to perform appropriate work recommended by the Director of Public Works
at said owners expense to abate the nuisance; and
BE IT FURTHER RESOLVED that the City Council has directed the City Clerk to cause to be
conspicuously posted on the premises a certified copy of this resolution as well as a "Notice of Public
Hearing"; and further that at least fifteen (15) days before the public hearing, the City Clerk shall cause
to be served on the owner one copy of the Notice of Public Hearing and a certified copy of the resolution;
and
BE IT FURTHER RESOLVED that the date and time fixed for the public hearing shall be on the 11th
day of August, 1992, at 7:30 P.M., in the City Council Chambers at 215 East Branch Street, Arroyo
Grande, at which time any and all interested parties may testify and present evidence regarding this matter.
