R 2930 RESOLUTION NO. 2930 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE AMENDING RESOLUTION NO. 2358 PERTAINING TO CALIFORNIA ENVIRONMENTAL QUALITY ACT RULES AND PROCEDURES, AND CHANGING THE NUMBER OF DAYS IN WHICH TO FILE AN APPEAL OF AN ENVIRONMENTAL DETERMINATION WHEREAS, the Rules an~ Procedures for the Implementation of the California Environmental Quality Act were adopted by City council of the City of Arroyo Grande Resolution No. 2358, and said document contained requirements for appealing an environmental -- determination by the Planning Director of the city; and WHEREAS, it is desirable for consistency and efficiency that the appeal process in the Rules and Procedures for Implementing CEQA conform with the appeal process in the Municipal Code of the City of Arroyo Grande, which states that the time within which an appeal shall be filed is fifteen (15) consecutive business days. NOW, THEREFORE, BE IT RESOLVED that the city Council of the City of Arroyo Grande amends Resolution No. 2358, and changes Section 12: APPEAL PROCESS, 12.2 A. to read as follows: A. Any person may appeal the Director's decision to require an EIR for a project to the Planning Commission within fifteen (15) consecutive business days of the date of the mailing of written notice to the applicant that an EIR is required. Discussion of the environmental determination will be placed on the next available Planning Commission agenda. The decision of the Planning commission shall be final unless appealed to the City Council. Municipal Code provisions for appeals to the City Council would then be followed. On motion of Council Member Smith , seconded by Council Member Dougall , and on the following roll call vote, to wit: AYES: Council Members Smith, Dougall, Moots, Gallagher and Mayor Milli!
