A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ARROYO GRANDE, CALIFORNIA
DECLARING THE COUNCIL'S INTENTION TO INITIATE
PROCEEDINGS TO FORM A LANDSCAPING AND LIGHTING
DISTRICT FOR ARROYO GRANDE TRACT 1769
WHEREAS, it is the intention of the City Council of the City
of Arroyo Grande to initiate proceedings for the formation of a
-- landscaping and lighting assessment district to install and
maintain landscaping in pUblic rights-of-way within Arroyo Grande
Tract 1769; and
WHEREAS, the Landscaping and Lighting Act of 1972 enables
local agencies to form assessment districts based on the provisions
of the Act as revised; and
WHEREAS, the formation of a landscaping installation and
maintenance assessment district, consisting of the property owners
in Tract 1769, will meet conditions placed on the approval of
permits for Tract 1769 development.
NOW, THEREFORE, BE IT RESOLVED that preliminary approval is
hereby given by the City Council of the City of Arroyo Grande to an
Engineer's Report which has been prepared ,pursuant to the
provisions of the Landscaping and Lighting Act of ~972 for purposes
of authorizing the levy of special assessments for certain work in
a special assessment district known and designated as Landscaping
District No. 1.
BE IT FURTHER RESOLVED that the City Council hereby initiates
proceedings ordering the formation of an assessment district to
install and maintain landscaping generally located as shown on
Exhibit "A" attached hereto and described as the private property
--~ owners of Tract 1769, Lots 1 through 30.
BE IT FINALLY RESOLVED by the City Council that the
improvements at Tract 1769 are specified as the installation and
maintenance of landscaping improvements and ornamental vegetation
in public rights-of-way to serve and benefit properties within the
boundaries of the District as well as any subsequent annexations.
On motion of Council Member Smith , seconded by
Council Member Gallagher , and on the following roll call
vote, to wit:
AYES: Council M=mbers Smith, Gallagher and Moots
NOES: None
ABSENT: Council M=mber Dougall and Mayor Millis
the foregoing resolution was passed and adopted this 28th day of
January, 1992.
