A RESOLUTION OF TilE ARROYO GRANDE CITY COUNCIL UPIIOLDlNG
TilE PLANNING COMMISSION'S APPROVAL OF CONDITIONAL USE PERMIT CASE
NO. 91-490, INCLUDING CONDITIONS OF APPROVAl. NUMBERS 11 AND 14,
APPLIED FOR BY SAI.LY WHITE, FOR A SJ.:COND RESIDENTIAL UNIT, LOCATED AT
250 RIDGEVIEW WAY, AND DENYING THE APPEAL OF TilE ABOVE DECISIONS
WHEREAS, the CHy of Anoyo G,'ande has received an application from Sally
White to construct a second residential unit at 250 Ridgeview Way in the Rural
Residential zone; and -
WHEREAS, City Staff recommended conditions of approval for the project
pursuant to the City Municipal Code; and
WIIERI~AS, the Planning Commission held a duly noticed puhlic hearing on
the project on November 19, 1991; and
WIIEREAS, after due study, deliberation and public heal'ing, the Planning
Commission on November 19, 1991 approved the application for the Conditional Use "
Permit Case No. 91-490; and
WIIEREAS, an appeal of the Planning Com mission t s decision to include
conditions of approval number 11 and 14 was filed on November 21, 1991 by Sally
White c/o Ed Chadwell; and
WIIEREAS, the Arroyo Grande City Council held a duly noticed public
hearing on the aforementioned appeal on December 10, 1991, at which time all
interested persons were given the opportunity to be heard; and
WIIEREAS, after due study, deliberation and public hearing, the City Council
makes the following findings of fact:
1. The findings hy the Planning Commission for approval of Conditional
Use Permit Case No. 91-490 were appropriate.
2. Condition of Approval number 11 is appropriate and is a requirement -
of the City's Development Code.
3. Condition of Approval number 14 is appropriate and is a requirement
of the City's Municipal Code. Furthermore, the applicant has not
provided evidence that the requested private septic system will not
be a health hazard or a public nuisance as required by the
Municipal Code.
NOW, THEREFORE, BE IT RESOLVED that the Arroyo Grande City Council
hereby
I. Adopts the findings made by the Planning Commission in the Planning
Commission Resolutions adopted November 19, 1991 in this matter, which
findings are incorporated herein by reference; and
2. Upholds the Planning Commission's approval of Conditional Use Permit Case
No. 91-490 including conditions of approval numbers 11 and 14,; and
4. Denies the appeal of the Planning Commission's actions on the above
