1. CALL TO ORDER
Mayor Pro Tern Barneich called the Regular City Council Meeting to order at 6:00 p.m.
2. ROLL CALL
City Council: Council Member Jim Guthrie, Council Member Tim Brown, Council
Member Barbara Harmon and Mayor Pro Tern Kristen Barneich were
present. Mayor Jim Hill was absent.
City Staff Present: Interim City Manager Bob McFall, City Attorney Tim Carmel, Deputy City
Clerk Kitty Norton, Director of Community Development Teresa McClish,
and Public Works Director Geoff English.

Maria, et al. and related actions, Santa Clara Superior Court, Case No. CV 770214
City Attorney Carmel reported that the Council met in closed session to discuss the Santa Maria
groundwater litigation strategy, and no reportable action was taken.

City Attorney Carmel reported that the Council met in closed session to discuss the status of the
City Manager recruitment, and no reportable action was taken.

City Attorney Carmel reported that the Council met in closed session to discuss the status of the
City Manager recruitment and City Attorney's performance, and no reportable action was taken.
5.b. Ordinances Read in Title Only.
Council Member Brown moved, Council Member Guthrie seconded, and the motion passed
unanimously that all ordinances presented at the meeting shall be read by title only and all
further readings be waived.
6. SPECIAL PRESENTATIONS
6.a. Honorary Proclamation Declaring April 2015 as "Sexual Assault Awareness
Month".
Mayor Pro Tern Barneich presented an Honorary Proclamation declaring April 2015 as "Sexual
Assault Awareness Month". Jesse Torrey, Associate Director of RISE, accepted the
Proclamation.
6.b. Honorary Proclamation Declaring April 2015 as "Month of the Child" and "Child
Abuse Prevention Month".
Mayor Pro Tern Barneich presented an Honorary Proclamation declaring April 2015 as "Month
of the Child" and "Child Abuse Prevention Month". Maddy Quaglino, on behalf of the Child Care
Planning Council of San Luis Obispo, accepted the Proclamation.
6.c. Honorary Proclamation Declaring April 24, 2015 as "Arbor Day".
Mayor Pro Tern Barneich presented an Honorary Proclamation declaring April 24, 2015 as
"Arbor Day". Scott Dowlan, Arroyo Grande Tree Guild, accepted the Proclamation.
City Arborist Pete McClure presented Mayor Pro Tern Barneich with an Arbor Day flag, plaque
and hat.
6.d. Presentations by Phillips 66, Union Pacific Railroad, and Mesa Refinery Watch
Group Regarding the Santa Maria Refinery Rail Project.
Jim Anderson representing Phillips 66, Laurence Shinderman representing Mesa Refinery
Watch Group, and Liisa Stark representing Union Pacific Railroad provided PowerPoint
presentations outlining information regarding the Santa Maria Refinery Rail Project. At the
conclusion, presenters and staff responded to questions from Council regarding the project.

7. CITIZENS' INPUT, COMMENTS, AND SUGGESTIONS
Mayor Pro Tern Barneich invited public comment. Speaking from the public were: Gina
Whitaker, Arroyo Grande, in opposition to the rail spur project and urged the City Council to
submit a letter to the San Luis Obispo County Planning Department and the San Luis Obispo
County Board of Supervisors relaying citizens' concerns as a community and opposing the
proposed rail project; Kay Gore, Arroyo Grande, in opposition to the rail spur project; Martin
Akel, in opposition to the rail spur project; Gary McKible, in opposition to the rail spur project;
Tom Ryan, in opposition to the rail spur project; Kevin McCarthy, concerned about the
disruption of soil when building the rail spur project due to potential exposure to Valley Fever
(coccidioidomycosis); Patty Welsh, requested the City implement a Stage One drought
emergency and expressed concerns about the water sign at the entrance of the Village; Diana
Robertson, in opposition to the rail spur project; and Tom Sear, concerned about land values
along the rail lines after the project is built.
8. CONSENT AGENDA
Mayor Pro Tern Barneich invited public comment on the Consent Agenda. No comments were
received.
Action: Council Member Guthrie moved, and Council Member Harmon seconded the motion to
approve Consent Agenda Items 8.a. through 8.d., with the recommended courses of action.
The motion passed on the following roll-call vote:
AYES: Guthrie, Harmon, Brown, Barneich

ABSENT: Hill
8.a. Consideration of Cash Disbursement Ratification.
Action: Ratified the listing of cash disbursements for the period March 16, 2015 through
March 31, 2015.
8.b. Consideration of Approval of Minutes.
Action: Approved the minutes of the Regular City Council Meeting of March 24, 2015
and the Special Meetings of March 24, 2015, March 27, 2015, March 28, 2015, and
March 31, 2015, as submitted.
8.c. Consideration of Temporary Use Permit 15-003 Regarding Street Closures for the
Amgen Tour of California Bike Race on Wednesday, May 13, 2015.
Action: Adopted a Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARROYO GRANDE APPROVING TEMPORARY USE PERMIT CASE
NO. 15-003; AUTHORIZING STREET CLOSURES AND RELATED ACTIONS FOR
THE AMGEN TOUR OF CALIFORNIA BIKE RACE, APPLIED FOR BY AEG
CYCLING, LLC".
8.d. Consideration to Declare Surplus Property.
Action: Adopted a Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARROYO GRANDE DECLARING A 1984 SERVICE TRUCK AS
SURPLUS AND AUTHORIZING ITS SALE OR DISPOSAL".

11. NEW BUSINESS
1'I.a. Presentation by Southern California Gas Company Pipeline Safety Enhancement
Project - Replacement Line Routing.
Recommended Action: Receive and comment on a presentation by Southern
California Gas Company staff about the proposed routing of the Pipeline Safety
Enhancement Project.
Mayor Pro Tern Barneich announced that at the request of the Southern California Gas
Company, this item has been continued to a date uncertain.
11.b. Consideration of a Donation of Artifacts found at Howard Mankins Hoosegow Park
to the South County Historical Society and Temporary Street Closure for Le Point
Street for Ribbon Cutting Ceremony.
Public Works Director English presented the staff report and recommended that the Council
adopt a Resolution: 1) Authorizing the donation of artifacts found during construction of the
Hoosegow Park Renovation Project to the South County Historical Society, and 2) Authorizing
the temporary closure of Le Point Street from Miller Way to Nevada Street on Saturday, April
25, 2015, from 9:00 a.m. until 12:00 p.m. for the Howard Mankins Hoosegow Park ribbon
cutting ceremony.
Jan Scott, curator, South County Historical Society, provided details about the dig and historical
items found.
Members of Council thanked all who were involved in the project.
Mayor Pro Tern Barneich invited public comment. No public comments were received.
Action: Council Member Brown moved to adopt a Resolution entitled: "A RESOLUTION OF
THE CITY COUNCIL OF ARROYO GRANDE AUTHORIZING THE DONATION OF
HISTORICAL ARTIFACTS FROM HOOSEGOW PARK TO THE SOUTH COUNTY
HISTORICAL SOCIETY AND AUTHORIZING TEMPORARY CLOSURE OF LE POINT
STREET FOR A RIBBON CUTTING CEREMONY". Council Member Guthrie seconded, and
the motion passed on the following roll-call vote:

11.c. Consideration of Governor's Statewide Mandatory Water Use Restrictions —
Potential Impacts on Arroyo Grande.
Public Works Director English presented the staff report and recommended that the Council
receive and comment on a report regarding potential impacts of Governor Brown's Executive
Order B-29-15 enacting statewide mandatory water conservation requirements and approve
additional water conservation measures to be implemented by City staff.
Council questions ensued regarding dialogue concerning water conservation with the local
schools; impact to turf when water is cut by 50%; use of non-potable water; and concerns about
small water users.
Mayor Pro Tern Barneich invited public comment. Speaking from the public were: Patty Welsh,
regarding water conservation and community involvement; Kevin McCarthy, concerned about
lack of water and water rationing; Patsy Sheehan, regarding a problem with animals chewing
through drip lines. No further public comments were received.
Action: Council Member Brown moved to receive the report regarding potential impacts of
Governor Brown's Executive Order B-29-15 enacting statewide mandatory water conservation
requirements and approve additional water conservation measures to be implemented by City
staff. Council Member Guthrie seconded, and the motion passed on the following roll-call vote:
AYES: Brown, Guthrie, Harmon, Barneich

12. COUNCIL COMMUNICATIONS
Council commented further on water conservation issues, including the one-size-fits-all solution
from the State being problematic; water board variables; small water purveyors and stronger
regulatory framework; future discussion about prohibiting new construction turf at residences;
rain barrels; listing the top 100 water savers on website, timing for adding Stage One Water
Emergency item to a City Council agenda, and State's release of water utilized for
environmental reasons to protect endangered species and habitat.
Council Member Harmon noted the special meeting of the SLO County Air Pollution District
Board of Directors on April 16, 2015 at 6:00 p.m. regarding its conference with district counsel
concerning Oceano dunes and reminded the public of a budget workshop for the Five Cities Fire
Authority Board on April 17, 2015 at 10:00 a.m.
Council Member Brown stated his interest in the goal of declaring a Stage One Water
Emergency in an effort to save an additional 9% of water in Arroyo Grande.
Council Member Guthrie requested a presentation from the County regarding Animal Shelter
replacement due to the City's expected contribution.
Council unanimously agreed, by voice vote, to direct staff to contact the County to request a
presentation regarding the Animal Shelter replacement.

Mayor Pro Tern Barneich requested the Rail Spur issue come back to Council for further
discussion.
Council unanimously agreed, by voice vote, to direct staff to bring the Santa Maria Refinery Rail
Project back for discussion after the item is presented to the County Planning Commission in
the near future.

15. CLOSED SESSION:
Mayor Pro Tern Barneich adjourned the regular meeting at 9:03 p.m. to closed session to

16. RECONVENE TO OPEN SESSION:
Mayor Pro Tern Barneich reconvened the meeting to open session at 10:12 p.m. Interim City
Manager McFall reported that the City Council gave further negotiating direction to the Interim
City Manager regarding the City Manager recruitment.

and Mayor Jim Hill were present.
Interim City Manager Bob McFall, Deputy City Attorney Heather Whitham, and City Clerk Kelly
Wetmore were also present.

Mayor Hill led the flag salute.

5. CITY COUNCIL CLOSED SESSION:

Deputy City Attorney Whitham announced that the Council would adjourn to closed session to
consider Public Employee Performance Evaluation pursuant to Government Code Section

Mayor Hill reconvened the meeting to open session at 7:07 p.m. Deputy City Attorney Whitham
announced the Council met in closed session to discuss the legal services provided by the City
Attorney, and there was no reportable action taken.

Mayor Hill adjourned the meeting at 7:08 p.m.
