R 2891 RESOLUTION NO. 2891 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE FINDING A PUBLIC NUISANCE AND ORDERING ABATEMENT THEREOF AT 570 LEMON LANE WHEREAS, the City Council of the City of Arroyo Grande has held a public hearing on October 8, 1991 to ascertain whether a public nuisance exists at the property located at 570 Lemon Lane, more particularly described as follows: In the City of Arroyo Grande, County of San Luis Obispo, State of California, Lots 1 and 2 of Parcel Map 87-76-7 and identified by County Assessor's Parcel Nos. 07-441-34 and 07-441-35. WHEREAS, the City Council has found at the public hearing that a pUblic nuisance does exist on the property and the owner of said property has not complied with requests from the Chief of Building and Fire and the Chief of Police to .remove the nuisance: and WHEREAS, it is necessary to resolve the jIlatter as expeditiously as possible because there are a dilapidated disabled vehicle and parts thereof, a trailer, and a camper causing a health and safety risk, harming the aesthetics of the neighborhood and creating a condition tending to reduce the value of private property: and WHEREAS, the vehicle and parts thereof, trailer and camper are described as follows: 1. White slide-in camper 2. Red utility trailer 3. Jeep pick-up cab shell on frame and body parts NOW, THEREFORE, BE IT RESOLVED, that it is the finding of the City council of the City of Arroyo Grande that a public nuisance does exist as described above, and that the owner of the property is responsible for the removal of said materials from the property. BE IT FURTHER RESOLVED that the City Clerk is hereby directed to serve notice upon the owners of the aforementioned property, in accordance with Arroyo Grande Municipal Code Title 4, Chapter 11, that the pUblic nuisance shall be abated by the owner within five (5) days of the mailing of this notice of the council's decision: BE IT FURTHER RESOLVED that in the event abatement has not been completed in full by the owner, it is the intent of the City Council to direct the Chief of Police to abate said nuisance by removal of the materials to a scrapyard or automobile dismantler's yard, and assessing the costs thereof to the owner of said property. On motion of Council Member Dougall, seconded by Council Member Smith, and on the following roll call vote, to wit: AYES: Council Members Dougall, Smith, Moots and Mayor Millis NOES: None ABSENT: None the foregoing Resolution was passed and adopted this 8th day of October, 1991. ~>~ <- M.
