RESOLUTION NO. 2482
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ARROYO GRANDE THAT
A PUBLIC NUISANCE MAY EXIST AT 513 BAKEMAN LANE
WHEREAS, the owner of the property located at 513 Bakeman Lane
has constructed a glass sun room without benefit of a City of
Arroyo Grande Building Permit and Planning Department approval
required of property is located in a Planned Development Zone; and
WHEREAS, the sun room has been constructed on top of a
__ sani tary sewer easement, and the owner of the property and the
building contractor previously have been informed by the Planning
Department that the project could not be permitted due to the sewer
easement; and
WHEREAS, on July 9, 1991 an official notice was personally
delivered to both the owner of the property and the building
contractor directing them to remove the structure, and that they
were subject to penalties as outlined in section 9-01.150 of the
Arroyo Grande Development Code.
NOW, THEREFORE, BE IT RESOLVED that the City Council does
find, based on the recommendations of the City of Arroyo Grande
City Attorney and Chief Building Official, that a Public Nuisance
may exist on the aforementioned property commonly known as 513
Bakeman Lane, Arroyo Grande, California. and more particularly
described as follows:
Lot 38 of Farroll Heights Tract No. 1050, in the City of
Arroyo Grande, County of San Luis Obispo, State of
California, Assessor's Parcel No. 77-252-038.
BE IT FURTHER RESOLVED that in the event that finding that a
Public Nuisance exists, it will be the intent of the City Council
to direct the Chief Building Inspector to remove the glass sun room
-- in an approved manner at the property owner's expense.
BE IT FURTHER RESOLVED that the City Council has directed the
City Clerk to cause to be conspicuously posted on the premises a
certified copy of this Resolution, as well as a "Notice of Public
Hearing," and further that at least fifteen (15) days before the
Public Hearing the City Clerk shall cause to be served on the owner
one copy of the "Notice of Public Hearing" and a certified copy of
this Resolution.
BE IT FURTHER RESOLVED that the date and time for the Public
Hearing shall be on the 27th day of August, 1991 at 7:30 P. M. in
the City Council Chambers, 215 E. Branch street, Arroyo Grande, at
which time any and all interested parties may testify and present
evidence regarding this matter.
On motion of Council Member Moots, seconded by Council Member
Olsen, and on the following roll call vote, to wit:
AYES: Council Members Moots, Olsen and Mayor Millis
NOES: None
ABSENT: Council Members Dougall and Smith
the foregoing Resolution was passed and adopted this 23rd day of
