RESOLUTION NO. 2443
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ARROYO GRANDE FINDING A PUBLIC NUISANCE AND
ORDERING ABATEMENT THEREOF AT 221 CORBETT CANYON ROAD
WHEREAS, the City Council of the City of Arroyo Grande has
adopted a resolution declaring its intent to hold a public hearing
to ascertain whether a public nuisance exists at the property
located at 221 Corbett Canyon Road, and more particularly described
as a portion of Lots 29 and of Vachells subdivision and Lot 56 of
Steeles subdivision; APN 007-031-027; and
WHEREAS, said pUblic hearing was held at the regular meeting
of January 22, 1991: and
WHEREAS, it is necessary to resolve the following matter as
expeditiously as possible due to:
1. Lack of approved permits for a project commenced at
221 Corbett Canyon Road
2. Location of construction debris is in a flood zone
adjacent to Tally Ho Creek, as shown on the Flood
Insurance Rate Map, Panel 1 of 2, Community Panel
Number 060305001C, effective date September 19, 1984.
NOW, THEREFORE, BE IT RESOLVED that it is the finding of the
City Council of the City of Arroyo Grande that a public nuisance
exists as described above and said nuisance shall be abated within
45 days after adoption of this resolution by rellOval of the
construction debris, restoring the site, and by re-seeding the
graded area; and
BE IT FURTHER RESOLVED that the City Clerk is hereby directed
to serve upon the owners of the aforementioned property in
accordance with Ordinance No. 309 C.S., a copy of this resolution;
and
BE IT FURTHER RESOLVED that in the event abatement has not
been completed in full by the owner, it is the intent of the City
Council to direct the Director of Public Works to abate said
nuisance and assess the costs thereof to the owner of said
property.
On motion of Council Member Dougall, seconded by Council
Member Moots, and on the following roll call vote, to wit:
AYES: Council Members Dougall, Moots, Smith and Mayor Millis
NOES: None
ABSENT: Council Member Olsen
the foregoing Resolution was passed and adopted this 22nd day of
January, 1991.
