RESOLUTION NO. 2435
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ARROYO GRANDE DECLARING ITS INTENT TO HOLD
A PUBLIC HEARING TO ASCERTAIN WHETImR A PUBLIC NUISANCE ....
EXISTS AT PROPERTY LOCATED AT 221 CORBETI' CANYON ROAD
(APN 007-031-027) NEWPORT PROPERTIES, GENERAL PARTNERSHIP
WHEREAS, the owner of the property located at 221 Corbett Canyon Road, (APN 007-
031-027) has not been issued a stockpile permit; and
WHEREAS, the area concerned lies within the 100 year nood zone as shown on the
Flood Insurance Rate Map, Panel 1 of 2, Community-Panel Number O603OS 0001 C, Effective
r Date September 19, 1984; and
WHEREAS, members of the Public Works Staff have met with the owner of said
property on several occasions regarding the dumping of construction debris in a flood zone
adjacent to Tally Ho Creek without a permit; and I

WIIERBAS, the agreed upon NovemlJcr 30, 1990, completion date for removal of dcbri~
has not been met as agreed upon during a meeting on October 31, 1990 between the Public
Works Staff and the owner's representative.
NOW, THEREFORE, BE IT RESOLVED that the City Council does find, based on
the recommendations of the Director of Public Works, that a Public Nuisance may exist on the
aforementioned property commonly known as 221 Corbett Canyon Road, Arroyo Orande, being
a portion of lots 29 and 56 of the Vaehells and Steeles subdivision. (APN 007-031-027) i

DE IT FURTHER RESOLVED that in the event that a finding that a Public Nuisance I
docs exist it will be the intent of the City Council to direct the Director of Public Works to
employ a competent general contractor to perform appropriate work -recommended by the
Director of Public Works at owners expense. to abate the nuisance; and i

BE IT FURTHER RESOLVED that the City Council has directed the City Clerk to
cause to be conspicuously posted on the premises a certified copy of this resolution as well as
a "Notice of Public Hearing"; and further that at least fifteen (IS) days before the Public
Hearing, the City Clerk shall cause to be served on the owner one copy of the notice of Public
Hearing and a certified copy of the resolution; and
DE IT FURTHER RESOLVED that the date and time fixed for the Public Hearing shall
be on the 22nd day of January, 1991 at 7:30 PM, in the City Council Chambers at 21S East
Branch Street, Arroyo Grande, at which time any and all interested parties may testify and
present evidence regarding this matter:
