FUNDING:
There are no direct City costs related to the proposed project. There has been a minimal
amount of Police Dept. staff time required to enforce the rules of the pilot program.
BACKGROUND:
In June 2009, the County of San Luis Obispo created an advisory body called the Homeless
Services Oversight Council (HSOC). The advisory committee consists of twenty four (24)
members, including a representative from each city council and the Board of Supervisors,
County government service providers, non-profit service providers, affordable housing
developers, local businesses, law enforcement, a local academic institution, a local health
care provider, the faith community and interested community members. The role of the
HSOC is as follows:
• Provide a planning and policy development forum with local jurisdictions and
public and private service providers to increase local awareness and participation
and to increase service coordination and efficiency.
• Work with service providers and local jurisdictions to compile and monitor data and
information regarding the number of homeless and service utilization.
• Advise service providers of opportunities and best practices to improve access to
services and to strengthen services.
• Advocate and provide local jurisdictions with recommendations on public funding
allocations based upon local needs and prioritized objectives within the 10-Year
Plan to End Homelessness.
• Work with public and private partners, donors and grant makers to establish
financial resources for service coordination and implementation.
HSOC has been working to create a regional homeless safe parking program, whereby a
series of volunteered sites are identified across San Luis Obispo County where homeless
persons and families in vehicles can safely park their vehicles overnight. Each site would
have only up to five (5) or six (6) identified parking spaces.

On November 30, 2011, St. Barnabas Church held a neighborhood meeting to discuss the
proposed Safe Overnight Parking Program. The Planning Commission considered the
proposed program on March 6, 2012 and unanimously recommended approval with the
modifications. On March 27, 2012, the City Council unanimously approved the application
and determined that it was consistent with the goals of HSOC and would serve as a pilot
project for a regional homeless safe parking program (Attachments 1 and 2).

Three (3) vehicles are allowed for an initial three (3) month period, after which there is an
option to increase the number of vehicles to five (5), if approved by the Community
Development Director. The start time of the three (3) month period began with approval of
the first program participant, which was April 16, 2012. Therefore, the number of allowed
vehicles may be increased to five (5) starting July 16, 2012, assuming the program is
operating smoothly. The church has reported that it has been difficult to find participants
that are suitable for the program. To date, only one program applicant has been approved
and is occasionally participating in the program. As such, the church is not requesting any
increase in the number of participants in the program at this time. The City Council

approved the pilot program for a six (6) month time period, which expires on September 27,
2012.
ANALYSIS OF ISSUES:
To date there have been 3 applications to participate in the program, one of which met the
program criteria and was approved. The approved participant occasionally utilizes the
program. There are four main observations regarding program operations at this time: first,
the program is not fully utilized likely due to strict requirements of the permit; second, there
have been no reported incidents specific to the program; third, there have been no
violations of any conditions of the Temporary Use Permit (TUP); and last, some neighbors
remain concerned that their neighborhood has been and will continue to be impacted by the
program.
The safe overnight parking program conditions of approval are as follows:
1. The pilot safe parking program shall adhere to the "Safe Parking Process" as follows:
a. A Case Manager at The Community Health Center (CHC), who works with
the homeless of the Five Cities Area, would refer people identified as
appropriate for the program. The Case Manager would screen applicants
through an interview and questionnaire to determine the qualifications of
applicant.
b. When approved by the Case Manager, the Case Manager will then contact
the Police Department for approval of all people who will be sleeping in the
vehicle. The Police Department will conduct a limited background check.
Anyone found to have a history of sexual violations, violent crimes or other
issues of concern to the police will not be allowed to participate in the
program.
c. The names of the qualified individuals, license and registration number of the
vehicle, and permit time period will be forwarded to the Police Department, St.
Barnabas Church office, and the church program manager.
d. A permit will be issued to be displayed in the vehicle. A copy of the rules will
be provided and a signed receipt obtained.
e. The church program manager will arrange for surveillance and be the contact
person for any problems.
2. The program is subject to the following rules:
a. No more than one (1) vehicle per family at a site.
b. Parking permit in vehicle window to be clearly visible.
c. Enter space between 7:00 and 9:00 PM and leave by 7:00 AM.
d. The use of alcohol or drugs will not be tolerated and result in immediate loss
of parking privileges.
e. Cooking outside the vehicle or the building of fires is not allowed.
f. Individuals are to sleep in the vehicle only— no tents are allowed.
g. No littering. All trash must be removed from the site.

h. Pet waste must be cleaned up and disposed of properly off site.
i. Loud music, generators or other loud noise is not permitted.
j. Permitted guests cannot invite other vehicles to the site.
k. Non-registered guests cannot be on the site.
I. Violent behavior, damage to property or uncooperativeness with church
representatives or police will result in immediate ejection from the site and
irrevocable dismissal from the program.
m. Participants are to leave the neighborhood during the daytime.
n. Participants are expected to respect and follow all laws of the community
including ordinances against panhandling.
o. Failure to comply with the above rules or to respond appropriately to requests
from representatives of the church or the police may result in the immediate
loss of parking privileges.
p. The church reserves the right to remove anyone from the program.
3. Three (3) vehicles and a supervisor vehicle are allowed for an initial six (6) month
period, with an option to increase to up to five (5) vehicles and a supervisor vehicle if
approved by the Community Development Director.
4. A portable restroom with washing facilities shall be provided on site.
5. The program shall be limited to people in south San Luis Obispo County.
6. Shielded lighting shall be installed in designated areas of the parking lot as approved
by the Police Department.
7. The pilot program shall expire on September 27, 2013 unless a one-year time
extension is granted or a Conditional Use Permit application is approved that
permanently establishes a safe parking program.
8. The applicant shall agree to defend, indemnify and hold the City harmless, at
his/her/its sole expense from any action brought against the City, its agents, officers,
or employees because of said approval, or in the alternative, to relinquish such
approval. The applicant shall reimburse the City, its agents, officers, or employees,
for any court costs and attorney's fees which the City, its agents, officers, or
employees may be required by a court to pay as a result of such action. The City
may, at its sole discretion, participate at its own expense in the defense of any such
action but such participation shall not relieve applicant of his/her obligations under
this condition.
9. Notwithstanding any other condition herein, the City Council shall have the authority
to rescind this approval and terminate this pilot program, with or without cause, at
any time.

A portable restroom and washing facilities have been provided on site. There was a delay
in the installation of shielded lighting. A letter was sent to the applicant on April 9th to remind
them of the requirement (Attachment 3). Additional lighting has been installed, however the
Church intends to raise the lights higher within the next week so that it will illuminate more of
the parking area. Church personnel patrol the site each night. They have also agreed to
sleep at the site when there is a registered participant.
According to the City's Police Department, there have been three (3) calls for service at the
St. Barnabas Church since the start of the program. There were regular"security checks"
done by officers during this time period, with no significant activity noted. The following is a
brief breakdown of the calls for service:
04/21/12 @ 2044 hrs,. it was reported that three (3) vehicles were parked in the
church parking lot. Officers made contact with all involved parties and advised them
of the requirements for the "Safe Parking Program". All parties complied and left the
area.
04/29/2012 @ 2113 hrs., it was reported that unknown subjects were involved in a
verbal argument. Officers arrived on scene, checked the area and were unable to
locate anybody.
06/01/12 @ 0104 hrs., officers checked out an unoccupied vehicle that appeared to
be set up for sleeping. The vehicle was registered to the Pastor of the Church.
It should be emphasized that any additional incidents that may be mentioned or noted by
neighbors have not been reported to the Police Department. A neighborhood watch
meeting was held on April 25, 2012. As requested by the neighborhood watch group, staff
has installed three neighborhood watch signs.
It is important to note that this program is not designed as a solution to the homeless
problem. Other efforts are under way to develop more permanent facilities. However, it is
intended to help a limited number of people meeting the program criteria while these other
efforts are pursued. Additionally, it should be noted that the proposed pilot program is not
intended to facilitate or create a camping facility or allow recreational vehicle parking outside
of the parameters of this temporary permit. If in the future the Council approves a
permanent Safe Parking Program, concurrent minor code modifications may be
recommended.
Given compliance with conditions of approval and minimal issues, no Council action is
necessary at this time. Adjustments or changes can be made in September when the TUP
expires.

ADVANTAGES:
Although the Church is not requesting that the program be expanded to five vehicles at this
time, bringing this status report to the Council provides an opportunity for the public to be
informed about the program and allow an opportunity for the neighbors to report any
continuing concerns.
DISADVANTAGES:
There are no identified disadvantages to filing the status report. Neighbors have continued
to voice concerns about the program regarding its potential to attract homeless people that
are not registered in the program and degrade property values.
ALTERNATIVES:
1. Receive and file the status report; or
2. Provide direction to staff.
ENVIRONMENTAL REVIEW:
Staff has reviewed this project in compliance with the California Environmental Quality Act
(CEQA), the CEQA Guidelines and the City of Arroyo Grande Rules and Procedures for
implementation of CEQA. The parking lot at the project site is used by the church at all
hours and is currently not restricted. Based on the review, staff has determined that the
project is exempt pursuant to CEQA Guidelines Sections 15061(b)(3) in that there is no
possibility for the activity to have a significant impact on the environment, and 15305, in that
the minor alteration in land use limitations does not result in changes to land use or density.
PUBLIC NOTIFICATION AND COMMENTS:
The Agenda was posted in front of City Hall on Thursday, July 5, 2012. The Agenda and
report were posted on the City's website on Friday, July 6, 2012. No public
comments were received.

WHEREAS, a lack of adequate affordable housing in the County of San Luis Obispo
and City of Arroyo Grande results in many individuals and families living in their
recreational vehicles and automobiles; and -
WHEREAS, St. Barnabas Church desires to provide a safe and sanitary place for
people to park their vehicles on a short-term basis while they transition to more
permanent housing; and
WHEREAS, St. Barnabas Church has applied fora Temporary Use Permit to establish
a pilot safe overnight parking program ("pilot program") as outlined in Exhibit "A"; and
WHEREAS, the St. Barnabas Church property ("property") is zoned Public Facility (PF)
with a design overlay (D-2.8); and
WHEREAS, the property is developed with a church facility including a parking lot
containing 95 spaces; and
WHEREAS, the Planning Commission reviewed the proposed pilot program as a non-
public hearing item on March 6, 2012 and recommended approval to City Council; and
WHEREAS, the City Council considered the proposed pilot program on March 27, 2012;
and
WHEREAS, the City Council finds that this project is consistent with the City's General
Plan, Development Code and the environmental documents associated therewith, and has
determined that the project is categorically exempt per Sections 15061(b)(3) and 15305 of
the California Environmental Quality Act (CEQA); and
WHEREAS, the City Council finds that, Arroyo Grande Municipal Code Sections
9.22.020.D, 9.22.030, 10.28.030 and 10.28.040 pertaining to overnight parking or
camping or recreational vehicle parking in a private parking lot notwithstanding, the pilot
safe overnight parking program applied for herein is allowable pursuant to issuance of a
Temporary Use Permit and compliance with all of the conditions thereof.
WHEREAS, the City Council finds, after due study, deliberation and public hearing, the
following circumstances exist:

FINDINGS FOR APPROVAL
1. The operation of the requested use at the location proposed and within the time
period specified will not jeopardize, endanger or otherwise constitute a menace
to the public health, safety or general welfare.
Operation of the pilot safe parking program will be in the eastern portion of the
existing parking lot of St. Bamabas Church. The church property is relatively
large (8.56 acres) and situated on top of a hill approximately 250' away from the
closest residence. Surrounding land uses include Agriculture to the north, low
density residential development and undesignated property (commonly referred
to as the "Arroyo Linda" property) to the east, low density residential
development to the south, and medium density residential development to the
west. The proposed "Safe Parking Program" and "Rules" of the program are
intended to protect the public health, safety and general welfare of the
community. Because it is a pilot program, assessment will be ongoing
throughout the one-year temporary time period. The program can be terminated
at any time during this period if issues arise that constitute a menace to public
health, safety or general welfare or if permit conditions are violated.
2. The proposed site is adequate in size and shape to accommodate the temporary
use without material detrimental to the use and enjoyment of other properties
located adjacent to and in the vicinity of the site.
The program property is large in size (8.56 acres) and situated on top of a hill
away from existing residential development.
3. The proposed site is adequately served by streets or highways having sufficient
width and improvements to accommodate the kind and quantity of traffic that the
temporary use will or could reasonably be expected to generate.
The church property is accessed by a private driveway off of Trinity Avenue, an
improved public street with sufficient width to accommodate up to five (5)
additional vehicles.
4. Adequate temporary parking to accommodate vehicular traffic to be generated by
the use will be available either on-site or at alternate locations acceptable to the
Community Development Director.
Adequate parking is provided on the church property for the proposed program.
The church site contains 95 parking spaces, and the program will accommodate
up to five (5) vehicles during off business hours (from 7:00 PM to 7:00 AM).

Associate Planner Heffernon presented the staff report and recommended the City Council
adopt a Resolution approving Temporary Use Permit No. 12-002.
Mayor Ferrara invited the applicant toaddress the Council.
Speaking on behalf of St. Bamabas Church, in support of the proposed pilot safe overnight
parking program were David Murray, Sr. Warden; Jan Stone, Case Manager for Community
Health Centers; Patty Diefenderfer, Program Coordinator; and Reverend Valerie Valle, Pastor.
Council questions of staff and the applicant's representatives ensued regarding the level of
mental health screening proposed; whether St. Barnabas staff will be present onsite to ensure
everyone has left the premises in the morning; how the Police Department enforces the City's
overnight camping Ordinance; how many citations have been issued in the City for overnight
' camping; monitoring.of permits by the Case Manager (3 per night initially); clarification of
applicant screening; rules of conduct; on-site cooking facilities; playground use; and pet waste
disposal.

Subject: Temporary Use Permit No. 12-002 (Pilot Safe Overnight Parking Program)
Dear Rev.Valle:
On March 27, 2012 the City Council approved the above project, subject to the attached conditions.
Please review the conditions carefully; as the applicant, you are responsible to see that the conditions are
implemented. This will involve working with the various departments that conditioned the project.
Note that Condition No. 6 requires that shielded lighting, as approved by the Police Department, must be
installed in the parking lot area designated for overnight parking. We understand'that to date the Case
Manager has approved one individual who has already participated in the pilot program. Given that the
program is now in operation, it is imperative that the lighting be installed as soon as possible. We
appreciate that you are looking into lighting options and cost estimates and hope this issue will be resolved
quickly.
Note also that three (3) vehicles are allowed for an initial three (3) month period, after which there is an
option to increase the number of vehicles to five (5). The start time of the three (3) month period began
with approval of the first participant, which was April 16, 2012. Therefore, the number of allowed vehicles
can be increased to five (5) starting July 16, 2012, assuming the program is operating smoothly. Allowing
an increase in participation will be based on an administrative assessment of the program.
The City Council approved the pilot program for a six (6) month time period, which expires on September
27, 2012. If the program is to continue past September,we will need a letter from you requesting to extend
the program for an additional six (6) months. An application fee is not necessary, although the City Council
will consider the request at a regularly scheduled meeting and the immediate neighborhood around the
