RESOLUTION NO. 2318
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ARROYO GRANDE FINDING A PUBLIC
NUISANCE AND ORDERING ABATEMENT THEREOF
AT 120 E. BRANCH STREET
WHEREAS, the City Council of the City of Arroyo Grande has
adopted a resolution declaring its intent to hold a public hearing
to ascertain whether a pUblic nuisance exists at the property
located at 120 E. Branch street, Arroyo Grande, and more
particularly described as a Portion of Lots 4 & 5, Nevada Tract,
and shown as Parcel No. 44 in Book 07, Page 491 in the assessment
roll of the County of San Luis Obispo; and
WHEREAS, the owner of said property has failed to remove five
(5) large signs the City has found exceed the standards allowed
within the CBD Zone of the City's zoning ordinance; and
WHEREAS, the signs in question are attached to the face of the
building and have not been reviewed by the Planning and Building
Departments; and
WHEREAS, a duly notices public hearing was held at the regular
meeting of June 13, 1989; and
WHEREAS, testimony was given by the City Staff, and the pUblic
was invited to comment in favor of or against the finding of a
public nuisance.
NOW, THEREFORE, BE IT RESOLVED that it is the finding of the
city Council of the City of Arroyo Grande that public nuisance
exists as described above and said nuisance shall be abated within
30 days after adoption of this resolution; and
BE IT FURTHER RESOLVED that the city Clerk is directed hereby
to serve upon the owners of the aforementioned property in
accordance with Ordinance No. 309 c.s., a copy of this resolution;
and
BE IT FURTHER RESOLVED that in the event abatement has not
been completed in full by the owner, it is the intent of the city
Council to direct the Director of planning to abate said nuisance
and assess the costs thereof to the owner of said property.
On motion of Council Member Moots, seconded by Council Member
Smith, and on the following roll call vote, to wit:

ABSENT: None
the foregoing Resolution was passed and adopted this 13th day of
June, 1989.
