RESOLUTION NO. 2315
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ARROYO GRANDE THAT
A PUBLIC NUISANCE MAY EXIST AT 120 E. BRAI\DI ISlliIZl'
WHEREAS, the owner of the property located at 120 E. Branch
Street has failed to remove five (5) large signs the City has found
exceed the standards allowed within the CBD Zone of the City's
Zoning Ordinance: and
WHEREAS, the signs in question are attached to the face of the
building and have not been reviewed by the Planning and Building
Departments: and
WHEREAS, the owner has not responded to letters sent in
January and April, 1989 by the Planning Department requesting the
removal of the signs.
NOW, THEREFORE, BE IT RESOLVED that the city Council does
find, based on the recommendation of the Planning Director, that
a PUblic Nuisance may exist on the aforementioned property commonly
known as 120 E. Branch street, Wilkinson Market, Arroyo Grande,
California, and more particularly described as follows:
In the city of Arroyo Grande, County of San Luis
Obispo, State of california, Portion of Lots 4 & 5,
Nevada Tract, and shown as Parcel No. 44 in Book 07,
Page 491 in the assessment roll of the County of San
Luis Obispo.
BE IT FURTHER RESOLVED that in the event that finding that a
Public Nuisance exists, it will be the intent of the city Council
to direct the Planning Director to cause the above mentioned signs
to be removed in an approved manner at the property owner's
expense.
BE IT FURTHER RESOLVED that the city Council has directed the
City Clerk to cause to be conspicuously posted on the premises and
certified copy of this Resolution, as well as a "Notice of Public
lIearing," and further that at least fifteen (15) days before the
Public Hearing the city Clerk shall cause to be served on the owner
one copy of the "Notice of Public Hearing" and a certified copy of
this Resolution.
BE IT FURTHER RESOLVED that the date and time for the Public
Hearing shall be on the 13th day of June, 1989 at 7:30 P.M. in the
City council Chambers, 215 E. Branch street, Arroyo Grande, at
which time any and all interested parties may testify and present
evidence regarding this matter.
On motion of council Member !>Pots , seconded by Council
Member ~9a11 , and on the following roll call vote, to wit:
AYES: Council Members Moots, Dougall, Olsen and Mayor Millis
NOES: None
ABSENT: Council Member Smith
the foregoing Resolution was passed and adopted this 2Jrd day of
May, 1989.
