A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO
GRANDE SETTING FORTH ITS INTENTION TO VACATE AND ABANDON
A PORTION OF CORNWALL AVENUE, IN THE CITY OF ARROYO GRANDE,
AND FIXING TIME AND PLACE FOR HEARING AS PROVIDED BY
GOVERNMENT CODE SECTION 50430, ET SEQ
WHEREAS, the City Council of the City of Arroyo Grande
elects to proceed within the vacation and abandonment of a
portion of Cornwall Avenue, pursuant to section 50437 of the
Government Code of the State of california; and
WHEREAS, it appears that Cornwall Avenue is unnecessary
for present or prospective public use; and
WHEREAS, it appears that a portion of Cornwall Avenue is
not required for future or present circulation; and
WHEREAS, the abandonment of Cornwall Avenue is necessary
to facilitate the expansion of police department facility;
and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ARROYO GRANDE that it intends to vacate and
abandon the hereinafter described portion of Cornwall Avenue
in the city of Arroyo Grande, County of San Luis Obispo,
State of California. For this purpose, the City Council will
hold a Public Hearing in connection with said intention to
vacate and abandon the hereinafter described portion of
Cornwall Avenue, which hearing will be held in the Council
Chambers, 215 East Branch street, Arroyo Grande, on the 9th
day of May, 1989, at the hour of 8:00 P.M. at said time and
place, those persons interested in or objection to the
proposed vacation and abandonment may appear and be heard.
BE IT FURTHER RESOLVED that the city Clerk of the City
of Arroyo Grande be, and is herewith directed to cause to be
posted along said portion of Cornwall Avenue at intervals not
to exceed three hundred feet (300 ') in distance apart and at
least three (3) in number on said road, notices of passage of
Resolution, which said notices shall be entitled "NOTICE OF
INTENTION TO VACATE AND ABANDON A PORTION OF CORNWALL AVENUE,
IN THE CITY OF ARROYO GRANDE, COUNTY OF SAN LUIS OBISPO,
STATE OF CALIFORNIA."
In addition thereto, the City Clerk is herewith ordered
and directed to cause a copy of said Resolution to be
published at least two successive weeks prior to the hearing
in the newspaper of general circulation within the City,
which publication shall be at least ten (10) days prior to
the date of said hearing.
BE IT FURTHER RESOLVED that a portion of Cornwall
Avenue, which the city of Arroyo Grande proposes to vacate
and abandon, is more particularly described as follows:

All that portion of Cornwall Avenue of the Western
Addition to the Town of Arroyo Grande, in the city of Arroyo
Grande, County of San Luis Obispo, State of California,
according to the map recorded in Book B, Page 10 of Maps in
the office of the county Recorder of said county, described
as follows:
Beginning at the point of intersection of the easterly
line of North Halcyon Road and the southerly line of Cornwall
Avenue, said point being also the northwest corner of Block
1 of said Western Addition to the Town of Arroyo Grande;
thence easterly along the southerly line of Cornwall Avenue
to its point of intersection with the westerly line of North
Rena street; thence northerly along the westerly line of
North Rena Street to its intersection with the northerly line
of Cornwall Avenue: thence westerly along the northerly line
of Cornwall Avenue to its point of intersection with the
easterly line of North Halcyon Road: thence southerly along
the easterly line of North Halcyon Road to the true point of
beginning.
Including those portions of lot 1, Block 10 of said
Western Addition to the Town of Arroyo Grande described in
the deed to city of Arroyo Grande by the Pacific Telephone
and Telegraph company, a California Corporation recorded in
Volume 1366 Page 105 of Official Records in the office of the
County Recorder, San Luis Obispo County, California.
Excepting there from that portion of Cornwall Avenue
lying westerly of the easterly plan line of north Halcyon
Road as shown on map filed in Book 13, Page 91 of Licensed
surveys in the Office of the County Recorder, San Luis Obispo
County, california.
RESERVING, HOWEVER, subject to the above grant, a
blanket easement in the above described property for the
construction, maintenance, repair and replacement of water
and sewer mains, underground communication facilities,
drainage and drainage structures, and other utilities.
Further particulars as to the proposed vacation and
abandonment are shown on the map pertaining thereto on file
in the Office of the city Clerk of the city of Arroyo Grande,
California, a copy of which is attached hereto and labeled
Exhibit "A".

the foregoing Resolution was passed and adopted this 11 th
day of April, 1989.

of San Luis Obispo, State of California, do hereby certify under penalty
of perjury that the foregoing Resolution No. 2306 is a true, full and
[correct copy of said Resolution passed and adopted at a regular meeting
of said Council on the 11th day of April, 1989.
