RESOLUTION NO. 2302
-
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ARROYO GRANDE THAT
A PUBLIC NUISANCE MAY EXIST AT 1203 GRAND AVENUE
WHEREAS, the owner of the property located at 1203 Grand
Avenue has failed to comply with the Uniform Fire Code section
79.221e, which states any underground fuel storage tank out of
service for one year shall be removed; and
WHEREAS, the owner has not taken any steps toward removal of
such tank; and
WHEREAS, these conditions are a fire and explosion hazard; and
WHEREAS, the Fire Department of the city of Arroyo Grande has
issued numerous notices to remove the abandoned fuel tanks.
NOW, THEREFORE, BE IT RESOLVED that the City Council does
find, based on the recommendations of the Fire Chief and the Fire
Inspector, that a Public Nuisance may exist on the aforementioned
property commonly known as 1203 Grand Avenue, Exxon Gas Service
station, Arroyo Grande, california, and more particularly described
as follows:
In the City of Arroyo Grande, County of San Luis
Obispo, State of California, Tract 10, Portion of
Lot 7. Also identified as County Assessor's
Parcel No. 77-141-18.
BE IT FURTHER RESOLVED that in the event that finding that a
Public Nuisance exists, it will be the intent of the City Council
to direct the Fire Chief to employ a licensed certified company to
execute the proper removal of the abovementioned tanks in an
approved manner at the property owner's expense.
BE IT FURTHER RESOLVED that the City Council has directed the
City Clerk to cause to be conspicuously posted on the premises a
certified copy of this Resolution, as well as a "Notice of Public
Hearing," and further that at least fifteen (15) days before the
Public Hearing the City Clerk shall cause to be served on the owner
one copy of the "Notice of Public Hearing" and a certified copy of
this Resolution.
BE IT FURTHER RESOLVED that the date and time for the Public
Hearing shall be on the 11th day of April, 1989 at 7:30 P. M. in
the City Council Chambers, 215 E. Branch street, Arroyo Grande, at
which time any and all interested parties may testify and present
evidence regarding this matter.
On motion of Council Member &mth , seconded by Council
Member Dougall , and on the following roll call vote, to wit:
AYES: Council Members Smith, Dougall, Olsen, Moots and Mayor Millis
NOES: None
ABSENT: None
the foregoing Resolution was passed and adopted this 14th day of
