WHEREAS, the City CourteD of the. City of Arroyo Grande has considered a Variance application No. 81-112, fDed by Richard and Leslie Jones, fa' a Variance from the maximum buildq height of 15 feet at 311 Zogata Way In the "R-1" S~le PamDy Residential District; and I I WHEREAS, the CouncD fIncB that the foUow~ circumstances exist! I 1. The granting of the variance wID not be materially detrimental to other prq>erties . , I a' land uses in the area because the views CWTently enjoyed by the surrounding prq>erties wID not be significantly Impacted by the proposed develtpment. 2. There are exceptional 01' extraordinary circumstances applicable to the intended J use that do not apply to other prq>erties In the same zone. The prq>erty has a significant slope and is oddly shaped. 3. The strict application of the ordinance deprives such property of privneges enjoyed by other properties in the vicinity Q' in the same zone because the 15- foot restriction woold limit the buildable potential of the lot due to the steep slope and the odd shape of the lot. 4. The granting of the variance is compatible with the objectives, policies, and general land uses specified In the General Plan because the Intent of the urgency ordinance is being. met, as there Is substantial protection of the vlewshedg on adjacent property, and the prq>osed develtpl11ent is In conformance with the goals, policies and objectives of the General Plan. NOW, THERBPORE, BBrr RESOLVED that the City Courten of the City of Arroyo Grande hereby approves said Variance subject to the standard conditions of the City and thC6e listed below: 1. The develtpment of the site shall occur in substantial conformance with the plans approved by the City CourteD on January 26, 1988.
