RESOLUTION NO. 2189
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ARROYO GRANDE
CONCEPTUALLY APPROVING THE DONATION OF A
FIVE ACRE SITE TO THE CITY
WHEREAS, the County of San Luis Obispo has on November 24 ,
1987, approved and executed an "Agreement Authorizing the
Exchange of County Real Property" (County Resolution No. 87-516)
with the developer of Tract 1390 in the City of Arroyo Grande;
and
WHEREAS, said Agreement provides that said developers shall
donate to the City a five acre parcel of real property received
from the County, with said property to be developed by the City

within 10 years for "municipal office space only"; and
WHEREAS, said Agreement specifically conditioned said
donation upon the City "conceptually approving the proposed
donation within thirty (30) days after execution" of said
Agreement; and
WHEREAS, the City desires to satisfy the 30 day conceptual
approval deadline by this Resolution; and
WHEREAS, the City must comply with normal procedural and
review policies before finally accepting or rejecting the
"
proposed donation, and this Council finds that the intent and
objectives of the Agreement and the interests of all parties,
including the City, can best be preserved by the opening of an
escrow pending a final determination by the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Arroyo Grande as follows:
1. This Council hereby gives conceptual approval to the
donation 'by the developers of Tract 1390 (Royal Oaks) of

a five acre parcel of real property to the City for munici-
pal office space use only. Said property is described and
depicted upon Exhibit "A" attached hereto.
2. Pending completion of City procedural and review require-
ments necessary for a final decision to accept or reject
said donation, this Council authorizes the opening of a
contingent escrow for the transfer of said property at an
escrow company of developer's choice in the City of Arroyo
Grande.
3. At the completion of all City review and procedures, the
City shall either accept said donation, or place in escrow
for delivery to the County of San Luis Obispo an executed . .
quitclaim deed in favor of said County.
4. A certified copy of this resolution shall be delivered to
the Clerk of the San Luis Obispo County Board of Supervisors
on or before December 29 , 1987.

Member Johnson , and on the following roll call vote, to wit:
