Minutes 1967-07-25 431 CITY COUNCIL .9ULY 25th, 1967 ARROYO GRANDE, CAL9FORNIA The City Coancil met in regular session with Mayor. Wood presidingo Upon roll call Councilwoman Thompson, Councilmen Levine, Schlegel and Burt reported present. PLEDGE OF ALLEGIANCE AND INVOCAI°ION Mayor Wood led the Pledge of Allegiance to our flag; and immediately thereafter Reverend William Goins, Assistant Pastor of the Assembly af God Church in Arroyo Grande, delivered the invocation. APPROVAL OF MtNUTES The minutes of the regular meeting of July llth, 1967 were approved as prepared. APPROVAL OF WARRANTS A motion was made by Councilwoman Thompson, seconded by Councilman Levine, and ananimously carried that Ger~Pral Warrants No, 5 to and including No, 37 ~n the total amount of $18,7b4e44, arod Payroll Warrants No. 1 to and` including No, 77 in the total amourat of $11,744.75 and Trust and Agency Warrants No. 251 to and including No. 278 and Noa 302 in the total amount af $170<00 be approved and ordered paid. LETT'ER REGARDING WBLLIAMS BROS, SHOPPING GENTER ON GRAND AV€. Correspondence was received, signed by seven residents of Poplar St. area complaining about the trash being stored outside of containers and garbage trucks making pickups before 8:00 A.IN. at the Williams Brothers Shop:ping ~ Center at Elm St. and Grand Ave. Director of Public.Works Anderson advised that a letter was on file from the South County Sanitary Service, Inc. dated October 5th, 1965, signed by Mrs. D, L. Petersen, Office Manager, that arrangements to service the shopping center after 8:00 A.M. each day, Monday through Satur.day, had been made'. Director Anderson also notified that a report from Plenr~ing Director Gallc~p indicated that he had made three personal inspections of the premises and found it to be very clean and o.rderly and that Mr. Marlin Williams had advised him that he was making an effort to correct the matter to everyones s~tisfaction, and that he had contacted the Sanitatary Company regarding their agreement to pick up tra5h after 8:00 A,M. Mr. Williams advised the Council that he would personally supervise the trash disposition in the future to make sure the area was kept in a neat and orderly manner. Mr. Cattaneo was present, representing the South County Sanitary Service, and indicated that he was willing to cooperate as to the time of garbage pickup,'as far as feasible, but pickup after 7:00 A,M. would create a hard- ship for his Company. After discussion, a motion was made by Councilman Burt; seconded by Councilman Levine, and unanimousJy carried, that this matter be referred to the Planning Commission, for their determination as'to whet'her the time of garbage collection was a condition of granting Use Permit No. 38~ as referred to in their minutes of Oct4ber Sth, 1965, and,review and report tp the Council on all of the conditions of the use permit. ORDINANCE N0. 12 CeS, ORDINANCE OF THE CITY OF ARROYO GRANDE AMEND~NG CHAPTER 3, TCTLE 3, OF THE ARROYO GRANDE MUNI- CIPAL CODE RELATING TO SAL~S AND USE TAXES. On motion of Councilman Burt, seconded by Councilman Schlegel, and by the following roll calt vote, to wit: AYES: Councilwoman Thompson, Councilmen Levine, Schlegel, Burt and Mayor Wood. NOES; None. ABSENT: None. the foregoing prdinance was adopted this 25th day of July, 1967. PROPOSED JOINT POWERS AGREEMENT - CIT9ES-COUNTY PLANNlNG COUNCIL Mayor Wood reported that at the meeting of the Mayor's held on July 24th, t967, it was generally ag~reed that there existed a need for a County's and Cities' Regional Planning Council and that the Mayor's of Morro Bay and PaSo Robles had requested additional informat,ion prior to action by their respective Councils. After discussion it was agreed that this Council be in favor of the formation of such Planning Council. RESOLUTION AUTHORIZING APPLLCATION z0 LAFCo (Oceano-Va11ey Rd.4 Annexations) Dire.ctor Anderson presented a map of the two proposed annexations. reviewing that the Halcyon area had been deteted, and that the two remaining areas would have to be considered seperately as two inhabited annexations. Gity Attorney Seitz read the title of a Resolution authorizing application to the Local Agency Formation Commission relative to a proposal to annex territory to the City of Arroyo Grande, thereafter a motion was made by Councilman Schlegel, seconded by Councilman Burt, and unanimously carried. to dispense with reading the balance of this Resolution. On motion of Councilman Levine, seconded by Councilwoman Thompson, and by the following roll call vote, to wit; AYES: Councilwuman Thompson, Councilmen L~vine, Schlegel, Burt and Mayor Wood. City Clerk Miller briefly outlined for the Council, the proceedure required by the Government Code to be followed to annex ~n inhabited terri- tory. Mayor Wood advised that LAFCo is requesting petctions in favor>of annexation from residents within the area to be annexed prior to action by them. REQUEST TO ABANDON PORTION OF BENNETT AVE. A,G. D9S°6RBCT CEMETERY Upon being advised by Director Anderson that the deeds and easementss necessary for the City to have prior to abandoning this portion of Bennett Ave.~have not been received, it was agreed to take no action until such - time as said deeds and easements have been obtained, ANNUAL FINANCIAL-STATISTICAL REPORT fR~M WOQDS ANIMAL SHELTER The financial and Statistical Report from Woods Animal Shelter for the fiscal year of ,tuly lst, 1966 to June 30th, 1967, was received, reviewed and ordered filed. REPORT OF LEAGUE OF CALIF. CITIES RE: LEGISLATIVE BULLET9N City Clerk Mitler reviewed the legisTati've bulletin received from the League of California Cities' which outlined those bills now before the Assembly and Senate of particular interest to cities. ~ SET PUBLIC HEARING FOR REZONING ON S0. ~'RAFFBC WAY EXTENSION (Schmitt) A resolution of the City of Arroyo Grande Planning Commission recom- mending to the City CounciT an amendment to the Municipal Code by rezor+ing all that land as shown on Parcel Map recorded the 26th day of June, 1g67, in Book 2 of Parcel Maps at Page 14, records of San L.uis Obispo County from RA-B3 to HS and R-l,applied for by Mr, Paul Schmitt was received by the Council and discussed, A motion was made by Councilman Levine, seconded by Councilwoman Thompson, and unanimously carried, that a public hearing be set on the rezoning request of Mr, Paul Schmitt at 8;00 o'clock P.M. August 8th, 1g67 in the Council Chambers of the City Hall. RECEIVE BIDS FOR CURB-GUTTERS - A~PINE ST „ DOWER PARK, ELM ST. PARK Director Anderson reported that one bid had been received and opened on July 2Oth, 1967 at 2:00 P.M., as authorized for Project No. 90-67=2 for the eonstruction of curb and gutter on a portion of South Alpine Street, Dower Park and Elm Street Park. After Council discussion, and as recommended by Director Anderson, a motion was made by Councilman Schlegel, seconded by Councilman Burt, and unanimously carried, that the contract for the construction of concrete curb and gutters, on a portion of South Alpine Street, Dower Park and Elm Street Park, as submitted by Robert H. Newdoll, in the total amount of $4,084.00, be accepted, and that the Mayor and C~ty Clerk be authorized t~ sign the contract document on behalf of the City, _3_ 43~ CITY COUNCIL .~ULY 25th, 1967 ARROYO GRANDE, CALIFORNIA PAGE 4 REVIEW OF PROPOSED STREET GRADES FOR l°HE FAIR OAKS AREA City Engineer Garing presented and reviewed street grades prepared by him, for the Fair Oaks area, Director Anderson advised there were problems with permitting curb and gutter in tMis area as to changing street gr~des, drainage, etc. ~nd he felt a more precise st~dy should be made prior to Council action. After discussion, the Council referred the proposed street grades to the City Public Works Department for review and study and a reCOmmendation for salutions to the various problems that will arise with the adoption of these street grades. PROGRESS R~PORT - LOPEZ WATER SUPPLY REPORT FOR ,?UNE 1967 A progress report for the month of June 30, 1967 was received from the San Luis Obispo County Flood Control and Water Conservation District, and was review.ed and ordered filed. STATUS REPORT-S0. SAN LUIS OBISPO COUNTY SAN9~'ATSON DISTROCT The Council received, reviewed, and directed to file, a copy of the Fiscal Year summary report of the So. San Luis Obispo County Sanitation District. ~OUNCIL dISCUSSION ON RAPID TRANSIT SYSTEMS PROPOSED LEGISLAT90N Councilman Schlegel reported that he had a memo from the Auto Club of Southern California requesting vigorous opposition to the proposed Assembly Bill Nos. 1290 and 2092 which would place an additional tax on motor vehicles that would not be used for street purposes but would be used by the California Transportation f und for Rapid Transit Systems. After discus- sion, a motion was made by.Councilman Schlegel, seconded by Councilman Burt, and unanimously carr,ied, that City Attorney Seitz be instructed and directed to contact Senator Grunsky by telephone, expressing this City's views against Assembly Bill Nos. 1290 arad 20g2 and vigorously urging that he oppose this legislation. HIGHWAY MEETING - IN ATASCADERO JULY 26th, 196J Mayor Wood reported that there would be a Highway Meeting held in Atascadero, on July 26th, 1967 and he felt a representative of this City should be in attendance. After Covncil discussion, Director Anderson was requested to attend this Highway Meeting and report back to the Council at the next regular meeting.
