ARROYO GRANDE, CALIFORNIA
The City Council met in regular sessian. with Mayor Levine presiding. Upon
roll ca11, Council Members Sehlegel, Thompson, Wood and:Talley reported present.
PLEDGE OF ALLEGIANGE AND INVOCATION
Mayor Levine lead the Pledge of Allegiance to our Flag; and immediately
thereafter, Reverend John Lundgren of the Pentecostal Church of ~od of Grover
City, delivered the invocation,
APPROVAL OF MINiJTES
The minutes of the regular meeting of May 26, 1970, were approved ~.s pre~
pared.
APPROVAL OF WARRANTS
On motion of Councilman Schlegel, seconded by Councilwoman Thompson and
unanimously carried, General Warrants No. 1095 through No. 1152, in the total
amount of $32,154,69; and Payroll Warrants No, 1725 through No. 1803, in the
total amount of $13,789.65, were approved and ordered pafd.
LETTER FROM CITY OF PISMO BEACH RE: CONTRACT FOR BUILDING INSPECTION SERVICES
Administrator Butch read a letter from the City of Pi~mo Beach, requesting
that the City of Arrpyo Grande provide Building Inspection Services to the
City of Pismo Beach by contract agreement on a trial basis. After Council dis-
cussion, Administrator Butch was instructed to contact other cities to ascer-
tain how this type service is provided in other arease Administrator Butch
was authorized to advise the`City of Pismo Beach that this Council is in favor
of its proposal and to negotiate fees and extent of Building Inspection Ser-
vices to be provided by contract agreement.
FIVE CITIES JAYCEES & ARROYO VALLEY MUSTANGERS CLUB RE: FEE EXEMPT FIREWORKS LIC.
Administrator Butch advised that letters have been received from the Five
Cities Jaycees and the Arroyo Valley Mustangers Club, requesting fee exempt
business licenses to sell safe and sane fireworks, After Council discussion9
on ~notion of Councilman Wood, seconded by Councilman Talley and unanimously
carried, approval was granted to the Five Cities Jaycees for a fee exempt
business license for fireworks sales at the Williams Brothers Shopping Center,
from June 27 through July 4, 1970, subject to all Fire Department requirements.
On motion of Councilman Talley, seconded by Councilman Wood and unani-
mously carried, approval was granted to the Arroyo Va11ey Mustangers Glub for
a fee exempt business license for fireworks sales at 501 Grand Avenue, from
June 27 through July 4, 1970, subject to all Fire Department requirements.
A,G. VILLAGE MERCH. RE: ONE YR. EXT. UNDERGROUNDING UTILITIES ON BRANCH ST.
Administrator Butch reported that a letter has been received from the
Arroyo Grande Village Merchants Association, requesting that the City negotiate
with the State Division of Highways to reschedul.e the date for reconstruction
of Branch Street to 1973-74 fiscal year, to allow additional time for the
merchants to acquixe and develop off street parking and to enable all agencies
involved to better coordinate the redevelopment of Branch Street, which will
result in a more acceptable finished project. Laird Smitha reporting for the
Village Merchants Association reviewed proposed plans for merchant assessments
to provide necessary funds for proposed improvements on Branch Street and ad-
vised that acquisition, of property for an alley and off street parking develop-
ment between Short and Bridge Streets is nearing completfon, After Council
discussion, Administrator Butch was instructed to contact the State Division
of Highways and request that the Branch Street project be rescheduled for the
1973-74 fis.cal year for better coordination of the total proje~t for the re-
development of Branch Street,

Ci.ty Attorney Shipsey read the title of an Ordinance rezoning certain
property adjacent to The Pike from R~A~B~3 to R-1 and P~D, thereafter, a motion
was made by Councilman Sehlegel, seconded by Councilwoman Thompson and unanf-
mously carried, to dispense with reading the balance of this ordinance.

LEGISLATIVE BULLETIN FROM LEAGUE OF CALIFORNIA CITIES
Administrator Butch reviewed the latest legislative bulletins received
from the League of California Cities and summarized a letter and reports re-
ceived from the League of California Gities, in answer to the Council°s in-
quiry regarding proposed legislation for diversion of Highway Users Tax Rev-
enue for other than City, County and State Road Systems, which advised, that
the League Board has recommended support of the Constitution Revision Com-
mission recommendation permitting use of gas tax funds for public trans-
portation purposes, as well as streets and road~, as this proposed legisla-
tion would allow cities to establish their own prforities, based on their
transportation needso After Council discussion~ no action was taken on the
request of the State and local Chambers of Commerce request that the City
oppose legislation for diversian of Highway Users Tax Revenuee On other pro~
posed legislatfon, Administrator Butch was in.structed to write to Assemblyman
MacGillivray and Senator Grunsky opposing the adoption of AB 98 & SB 1293,

Employee Classi.fieations' Salary Ranges Step Plan, reflecting Council approved
22% cost of living increase for Department Heads and a 5% cost of living in-
crease for all other full time employees of the City of Arroyo Grandee After
Council discussion, City Attorney Shipsey read the title of a resolution es~
tablishing minimum and maximum ~ompensation in various departments of said
City, thereafter a motion w~s made by Coun~ilanan Schlegels seconded by Council°

REAPPOINTMENT OF PLANNING COMMISSIONERS ST. DEAi:IS & PORTER
Mayor Levine advised that the terms of office of Planning Commissioners
Ro~;~r Ao St, Denis and Chester D, Porter will expi~°e June 20a 1970 and that
he recommends their reappointmen.t as he has contacted both Commissioners and
they have indicated their c~illingness to continue to-serve on this Commission.
After Council discussion, on motion of Cmuncilwoman Thompson, seconded by
Councilman Talley and una~.imously carried, Roger A. St, Denis and Chester po
Porter were reappointed tn:serve ~s eornmissioners on the Arroyo Grande Plan~
ning Commission with their terms of office terminating on June 30,:1974.
NOTICE OF RESIGNATION ° PLA.NNII~G COMMISSIONER JOHN J. KANE
Mayor Levine reported that John Ja Kane had advised him that he wi11 be
unable to-seY°ve or~ the Planning Commission during the summer utonths, due to
prior committments, After Council discussion, on motion of Councilman Wood,
seconded by Councilman Schlegel ~nd unanimously aarried, the resignation of
John J. Kane from the Planning Cosamission was accepted; and Administrator
Butch was instructed to write a-letter of than.ks and appreciation to Mr, Kane
for his service to the City.
APPOINTMENT OF PLANNING COMMISSIONER CHAR.LES BOWLES
• Mayor Levine recommended that Charles Borales be appointed to the Planning
Commission to fill the vaeancy created by the resignation of John J. Kane. On
motion of Councilman Sehlegel, seconded by Councilwoman Thompson, and unani-~
mously carried, Charles Bowles, 440 Woodland Drive, was appointed to serve as
a commissioner on the Arroyo Grande Planning Commission, ~aith his term of
office terminating on June 30, 1972.
A.PPOINTMENT OF PARKING COMMISSIONER ROLLAND R, COGGESHALL
Mayor ~,evine reported that as Mr. Edward A. Boggia had aduised that he
did not wish to serve another term on the Parking Gom~ission, he would recom~
mend that Rolland R. Coggeshall be appointed to this commissiono

mously carried, Rolland R. Coggeshall, 418 Grand Avee,:was appointed_to serve
as a commissioner on the Arroyo Grande Parking Commission, with.his term of

SUIKMEER.RECREATION.1970 PROGRAM SGHEDULE OF ACTIVITIES
Administrator Butch distributed copies of the Suuuner Recreation 1970
Schedule of Activities program and advised that copies of the program:were
being distributed by the schools in the Lueia Mar Unified School District.

The minutes of the Coastal Valley Planning Couneil meeting of May 4,
1970 were received by the Council and ordered ffled,
PLANN„ COMM. RECOM, RE: LANDSCAPING PERFORMANCE BOND IN CONJUNCT, WITH USE PERMIT
Administrator Butch advised that the Planning Commission has requested
that the ~ity Council consider adopting the requirement that a pe~formance bond
be posted covering landscaping ~ahen required in conjunction with approval of
a Use Permit. After Council discussion, Administrator Butch was instructed to
contact other cities regarding results and modes of operation, where such re-
quirement is in effecto
SET PUBLIC HEARING - 522 E, BRANCH ST. REZONING CASE N0. 70-37 (LOOMIS)
The City Council received a resolution of the City Planning Commission
recommending;to the City Council an amendment to the Municipal Code by re-
zoning a portion of Lot 54 of the Resubdivisions of a part of the Ranchos
Corral de Piedra, Pismo and Bolsa de Chemisal, at 522 East Branch St, from R-1
to P-M, as requested by application submitted by Mr, Dauid Loomis.
After Council discussion, on motion of Councilman Schlegel, seconded by
Councilwoman Thompson and unanimously carried, a public hearing was set for
8:00 Pe M,, June 23, 1970, on the rezoning application submitted by Mr, David
Loomis.

PROGRESS REPORT - FAIR OAKS AVENUE EXTENSION AND BRIDGE
Administrator Butch reviewed a report, dated June 9, 1970, from Director
of Public Works Anderson, covering,a tentative schedule for Fair Oaks Avenue
Roadway - Project No, 90-70-1, City Engineer Garing:was present and reviewed
plan.s, whieh are now completed, for the Fair paks Avenue ~oadway construction
project. After Council review and discussion, on motion of Couneilman Wood,
seconded by Councilman Talley and unanimously carried, the plans titled "Fair
Oaks Avenue", dated June, 1970, as presented by City Engineer Garing, for the
construction of the extension of Fair Oaks Avenue from Woodland Drive to Valley
Road, were approved as presenteda
RECEIPT OF MINUTES - COUNTY WATER RESOURCES ADVISORY COMMITTEE
Copies of the minutes of the last County Water Resources Advisory Com-
mittee meeting have been received by the City and placed on file.
PROGRESS REPORT - LOPEZ WATER SUPPLY
A Progress Report on Lopez Water Supply for the month of April, 1970 was
received from the San Luis Obispo County Flood Control and Water Conservation
District, which was reuieraed and ordered filed.
PROGRESS REPORT - ARROYO GRANDE SEWER ASSESSMENT DISTRICT
Administrator Butch reported that the aerial photogrammetry of the sewer
district has now been completed by the project Engineers.
PROGRESS ItEPORT - SOUTH SAN LUIS OBISPO COUNTY SANITATION DISTRICT
Copies of the Chief Plant Operator's Report for the month of May,,1970,
and copies of the 1970-71 adopted budget for the District were received by
the Council, reviewed and ordered filed.
ADOPTION OF RESOLUTIONS REGARDING TOPICS PROGRAM
Ad`ministrator Butch reported that the County Board of Supervisors has
recommended that the San Luis Obispo County and Cities Area Planning Co-
ordinating Council be approved as the TOPICS "Coordinating Agent" for each
City and the County, therefore, if the Council wishes to appoint the Area
Planning Council as "Coordinating Agent" for the City, the resolution adopted <
by the Council appointing.the County as its agent would have to be rescinded
prior to adopting a resolution requesting the Area Planning Council be ap-
pointed. After Council discussion, City Attorney Shipsey, read the titie of
a resolution reseinding Resolution No, 869, thereafter a motion was made by
Councilman Schlegel, seconded by Councilwoman Thompson and unanimously carried,
to dispense with reading the balance of this resolution.

CITIZEN INQUIRY REe ADVERSE PUBLICITY OF ALLEGED CHILD BEATING
Alice Caras was present and inquired as to the Council"s intentions re-
garding recent publicity of Police Chief Richardson and the Police Departments
alleged negligence in investigation of an alleged chfld beating case, as re-
ported by the Santa Ma.ria Timeso Mayor Levine advised that this matter is
under full investigation and requested that anyone with any information to
please submit same to the Coun~fl in writing, and as soon as all reports and
findings regarding the matter have been compiled the Council will thoroughly
review same and should it appear assistance is needed the Council will not
hesitate to request an investigatio~. by an outside agencyo

A notice h~.s been received from the Board of Supervisors of the County of
Santa Cruz, advis~.ng that the Galifox°n.fa Council on Intergovernmental Relations
has established new regional boundarie~ fo~ Regional Planning District No. 7,
to include the count~es of San. Luis Obispos San Benito, Monterey and Santa
Cruz, an.d to consider the forming of a regional clearinghouse agency, an ex~
ploratory meeting has been scheduled for June 25, 1970 in Santa Cruz and re-

City Attorney Shipsey advised that if all Cities in the County would
adopt the County Animal Control Ordin.ance by reference, it would establish a

Administrator Butch xeviewed a letter re~efved from Robert Da Hubbartt,
1043-A Ritchie Rdo, Grover Gity, r~garding the need fo~° greater protectfon for
pedestrians and eyclists, expres~ing the need for more sidewalks and the estab-
lishment of bikeways, and i~provement of drai:nage gratings in the pavement,
:which will not allow a bicycle wheel to fall into the gratings, After Council
discussion, City Engineer Garing wa~ instructed to incorporate bicycle safe
drain guards into City spe~ifications and to prepare a cost comparison on curb
openings and grate open~ngs for drafnage inletso
