AN URGENCY ORDINANCE OF TUE CITY OF ARROYO GRANDE, CAI.TFORNIA
PROHIBITING ON AN INTERIM BASIS TUE ACCE~rANCE, CONSIDERATION
OR APPROVAL OF ZONE CHANGES, LAND DIVISIONS, BUILDING PERMITS,
ARCIIITECTUIUIL Rt;VU;W, OPTIONAL DESIGN STANDARDS AND CONDITIONAL
USE PERMITS WITII AREAS DESIGNATED ON THE GENERAL PLAN mR
MEDIUM-HIGH RESIDENTIAL (14 DWELLING UNITS PER ACRE) AND/OR
AREAS ZONED FOR R-3 PURSUANT TO SECTION 6~858 OF THE
CALIFORNIA GOVERN~1rr CODE
The City Council of the City of Arroyo Grande does ordain as follows:
SECTION 1. Findinqs:
1,1 The planning Commission and staff of the City have undertaken
the consideration and study of a general plan and zoning ordinance for
development within the City.
1.2 Such consideration and study will enable the City to develop such
a general plan and zoning ordinance for the City, including pOlicies and
standards for the reasonable regulation of land development within the City.
1.3 The continued use and development of land or structures within the
City in accordance with current regulations and the existing general plan may
be inconsistent with the policies and standards which are being or will be
considered by the Planning commission and staff of the City.
1.4 There is a current and immediate threat to the public health, safety
or welfare arising from the use and development of land and structures pursuant
to the existing general plan within areas designated on the general plan for
Medium-Hiqh Residential (14 dwelling units per acre) and/or areas zoned for
R-3 (Multiple Family).
1.5 A continuation of approval of uses and development of land within
the above areas pursuant to the existing general plan and zoning result in a
further threat to pUblic health, safety or welfare.
SECTION :I. prohibitions:
2.1 The acceptance, the consideration, and the approval of applications
for changes of zone on properties within the above ~reas is hereby,prohibited
for a period of forty-five days from and after the effective date of this
Ordinance,
2.2 The acceptance, the consideration, and the approval of applications
for division of land within the above Areas is being prohibited for a period of
forty five days from and after the effective date of this Ordinance.
2.3 The acceptance, the consideration, and the approval of applications
for the issuance of building permits within the above Areas is hereby prohibited
for a period of forty-five days from and after the effective date of this
Ordinance.
2.4 The acceptance, consideration and approval of applications for the
issuance of Architectural Review applications within the above Areas is hereby
prohibited for a period of forty-five days from and after the effective date of
this Ordinance.
2.5 The acceptance, consideration and approval of applications for the
issuance of Conditional Use Permit applications within the above Areas is hereby
,prohibited for a period of forty-five days from and after the effective date of
this Ordinance.
2.6 The acceptance. consideration and approval of applications for the
processing 01 Optional Design Zoning applications within the above Areas is
hereby prohibited for a period of forty-five days from and after the effective
date of this Ordinance.
SECTION 3. Expiration of Effect:
3.1 This Ordinance shall be of no further force or effect at the
expiration of forty-five days after the adoption of this Ordinance unless
extended by the City Council.

SECTION 4. Declaration of Urqencv:
4.1 This Ordinance is declared to be necessary as an urgency measure
pursuant to Section 65858 of the California Government code for the reasons set
forth in Section 1 hereof.
SECTION 5. Direction to Consider and studv:
~ , 5,1 The Planning Commission of the City of Arroyo Grande, and the staff
of the City, are hereby directed to take all due consideration, study and action
. relating to the development of a general plan and zoning ordinance, and of the
",... conditions which required the adoption of this Ordinance,
SECTION 6. NOTICE OF ADOPTIOII:
6.1 Within fifteen days after the adoption of this ordinance the City
Clerk shall certify to the adoption hereof and shall cause it to be published
once, together with the names of the Council Members voting thereon, in a
newspaper of general circulation within the City and posted in at least three
public places within the City. However, failure to pUblish or post for any
reason shall not affect the validity of the Ordinance.
6.2 Immediately upon the adoption of this ordinance. the City Clerk shall
I send certified copies hereof to the Clerk of the Board of Supervisors of the
County of San Luis Obispo, to the Planning Director of the County of
San Luis Obispo, to the presiding officer of the Planning COlbOlission of the
County of San Luis Obispo, and to each member of the Planning Commission of the
City of Arroyo Grande.
SECTION 1. Effective Date:
1.1 This ordinance shall become effective immediately upon the date of
its adoption by a 4/5 vote of the City Council.
On motion of Council Member Dougall, seconded by Council Member Smith,
