AN ORDINANCE Of THE CITY COUNCIL Of THE
CITY Of ARROYO GRANDE AMENDING THE ARROYO
GRANDE MUNICIPAL CODE TO DESIGNATE THE CURRENT
PLANNER AS THE ZONING ENfORCEMENT OffICIAL AND TO
GRANT CITATION AUTHORITY TO THE ZONING ENfORCEMENT
OffICIAL AS PROVIDED IN SECTION 836.5(a) Of THE
CALIfORNIA PENAL CODE
WHEREAS, this Council finds that the need exists for the City Zoning
Enforcement Official to have citation authority for the purpose of enforcing
duly adopted City Ordinances; and
WHEREAS, in certdin cases it has been extremely cumbersome for the
Zoning Enforcement Official to gain compliance on violations of City
Codes and Ordinances without resorting to a lengthly abatement process,
which is often not as effective or as appropriate as the issuance of
a citation.
WHEREAS, the Zoning Enforcement Official is the Current Planner.
NOW, THEREfORE, BE IT ORDAINED by the City Council of the City of
Arroyo Grande as follows: '
SECTION 1:
The Arroyo Grande Municipal Code is hereby amended by adding the
following sections, reading in full as follows:
Sec. 9-3.230. Zoning Enforcement Official.
"Zoning Enforcement Official" shall mean the Current Planner.
Sec. 9-3.803. Citation Authority.
(a) The Zoning Enforcement Official of the City of Arroyo Grande
is hereby granted the authority as provided in Section 836.5(a) of the
California Penal Code to Inake arrests and issue citations for violations
of the Arroyo Grande Municipal Code.
(b) Citation authority is hereby granted for violations which, under
City ordinances, constitute infractions or misdeamors.
SECTION 2:
This Ordinance shall be in full force and affect thirty (30) days
after its passage; and within fifteen (15) days after its passage it
shall be published once, together with the names of Council Members
voting thereon, in a newspaper published and circulated in said City.

Johnson, , and on the following roll call vote, to wit:
AYES: Council Members Porter, Johnson, Millis and Mayor Mankins
NOES: None
ABSENT: Council Member Moots
