O 357 C.S. 79 ORDINANCE NO. 357 AN INTERIM URGENCY ORDINANCE OF THE CITY OF ARROYO GRANDE PROHIBITING APPROVAL OF LOT SPLITS, PARCEL MAPS, OR OTHER ENTITLEMENTS FOR ADDITIONAL PARCELS IN THE HILLCREST DRIVE AREA PENDING STUDY OF CONTEMPLATED ZONING PROPOSALS TO INCREASE MINIMUM PARCEL SIZE I WHEREAS, this Council desires within a reasonable time t~ study proposed and contemplated zoning proposals to increase the minimum lot size in the Hillcrest Drive area to protect the public health, safety and welfare. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE DOES ORDAIN AS FOLLOWS: Section 1 This Council hereby finds and declares that it is necessary and appropriate for the City to contemplate and study zoning proposals to increase the minimum lot sizes in the hillside residential area generally described as along Hillcrest Drive between Sierra Drive and Newport Avenue, and as more specifically described and depicted within the shaded area shown on the Exhibit "A" map attached hereto and incorporated herein. Section 2 I Pursuant to the authority of California Government Code 65858, and notwithstanding the provisions of any other City ordinance, regulation, or plan, the City Council hereby orders I that no permits, approvals, or other entitlements shall be granted or issued during the effective period of this ordinance for any lot split, parcel map, subdivision or any other entitlement which would allow the'creation of new or additional parcels or residential units in the shaded area depicted upon the Exhibit "A" map; provided, however, that nothing herein shall be construed or applied to prohibit the right of any parcel owner to have one residential unit on each parcel of record. Section 3 Upon adoption by a four-fifths vote of the Council, this ordinance shall become effective immediately as an interim urgency ordinance for the protection of the public health, safety and welfare. The reasons for the urgency ordinance include the I Ou PAGE 2 ORDINANCE 357 C.S. fact that the City has denied an application for a par~el map (lot split) and the property owner has threatened litigation against the City; the City needs time to study and decide whether or.not a proposed zoning ordinance which increases minimum lot size and reduces parcel splitting is more appropriate for this I sensitive and scenic residential area. The Council finds that the proposed lot split and the potential for additional lot splits in the study area pose a current and immediate threat to the pUblic health, safety or welfare, and that the approval of additional subdivisions, parcel maps, or lot splits in the interim period would result in a threat to the public health, safety or welfare. Section 4 This Ordinance shall be in effect for 45 days after its adoption; provided that the Ordinance effectiveness may be further extended in accordance with Government Code 65858. Section 5 Within fifteen (IS) days after its passage, this ordinance , shall be published once, together with the names of the Council Members voting thereon, in a newspaper of general circulation within the City, but failure to publish for any reason shall not I effect the validity of the Ordinance.
