A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARROYO GRANDE APPROVING A MULTI-DWELLING
PROPERTY FIRE AND LIFE SAFETY ANNUAL INSPECTION
PROGRAM AND AMENDING THE MASTER FEE SCHEDULE
TO INCLUDE MULTI-DWELLING INSPECTION FEES
WHEREAS, California Health and Safety Code Section 13146.2 sets forth provisions for
cities providing fire protection services to annually inspect certain multi-dwelling structures
for compliance with building standards and other regulations ofthe State Fire Marshal; and
WHEREAS, California Health and Safety Code Section 13146.2 states the City may
charge and collect a fee for the inspection from the owner of the structure in an amount as
determined by the City as sufficient to pay its costs for the inspection; and
WHEREAS, the purpose of aMulti-Dwelling Property Fire and Life Safety Annual
Inspection Program ("Program") is to proactively identify substandard and unsafe building
conditions within the City of Arroyo Grande and to ensure correction of violations to meet
minimum standards; and
WHEREAS, the Department of Building and Fire will conduct annual inspections of multi-
dwelling buildings, including all residential rental buildings, rooming houses, hotels, motels,
and similar occupancies having three (3) units or more on one parcel or site; and
WHEREAS, the Program will also include inspections of common areas such as parking
lots, carports, driveways, laundry rooms, accessory structures, fences, walls, swimming
pools, hot tubs, and spas; and
WHEREAS, inspections will be based on the provisions of the State Housing Code,
California Health and Safety Code, California Building and Fire Code, the International
Property Maintenance Code, and the Arroyo Grande Municipal Code; and
WHEREAS, the City Council of the City of Arroyo Grande deems it in the best interest of
the City and its residents to approve aMulti-Dwelling Property Fire and Life Safety Annual
Inspection Program to protect life and property.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Arroyo Grande
hereby approves aMulti-Dwelling Property Fire and Life Safety Annual Inspection Program.
BE IT FURTHER RESOLVED that the City Council of the City of Arroyo Grande hereby
amends the Master Fee Schedule for the Fire Department to include multi-dwelling fire and
life safety inspection fees, asset forth in Exhibit A, attached hereto and incorporated herein
by this reference.
BE IT FURTHER RESOLVED by the City Council that this Resolution shall become
effective on August 1, 2008.
