R 4825 RESOLUTION NO. 4825 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE APPROVING THE INSTALLATION OF A PUBLIC ART MURAL ENTITLED "FUTURE CITY LEADERS" (STAFF PROJECT 17-010); LOCATED ON THE EASTERN WALL OF THE CITY COUNCIL CHAMBERS AT 215 E. BRANCH STREET; APPLIED FOR BY ARROYO GRANDE PUBLIC ART WHEREAS, in 2002, the City Council approved the Art in Public Places Program and Process; and WHEREAS, in 2011, the City Council amended the Public Art Guidelines to evaluate public art proposals within the City; and WHEREAS, in 2013, Arroyo Grande Public Art was established as a program within Arroyo Grande in Bloom to help facilitate public art proposals within the City; and WHEREAS, Arroyo Grande Public Art has proposed the "Future City Leaders" mural to be installed on the eastern wall of the City Council Chambers; and WHEREAS, in accordance with the Public Art Guidelines, the Parks and Recreation Commission reviewed the art proposal on October 2, 2017 and recommended the City Council approve the proposal; and WHEREAS, the Public Art Panel reviewed the art proposal on October 30, 2017 and recommended the City Council approve the proposal; and WHEREAS, the City Council has reviewed the project in compliance with the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the Arroyo Grande Rules and Procedures for Implementation of CEQA and has determined that the project is categorically exempt per Section 15301(e) of the CEQA Guidelines regarding existing facilities; and WHEREAS, the City Council has reviewed the art proposal at a duly noticed public hearing on November 14, 2017; and WHEREAS, the City Council finds, after due study, deliberation and public hearing, the art proposal is acceptable in light of the following selection criteria outlined in the Public Art Guidelines of the City: SELECTION CRITERIA— PUBLIC ART 1. Relationship to the social, cultural, and historical identify of the area. 2. Evaluation of artistic excellence. RESOLUTION NO. 4825 PAGE 2 3. Appropriateness of scale, form, material, content and design relative to the immediate and general neighborhood. 4. Appropriateness of proposal materials as regards to structural and surface integrity, protection against vandalism, public safety and weathering. 5. Ease of maintenance. 6. Appropriateness of proposed method of installation of artwork and safety and structural factors involved in installation. 7. Artist's experience in working on comparable projects. WHEREAS, the City Council finds that the "Future City Leaders" art proposal is acceptable when evaluated against the above criteria and will provide a unique opportunity to engage the local youth in a distinctive civic project. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Arroyo Grande does hereby approve Staff Project 17-010 for the installation of the "Future City Leaders" public art proposal as set forth in Exhibit "B" and subject to the conditions as set forth in Exhibit "A", attached hereto and incorporated herein by this reference: On motion of Council Member Harmon, seconded by Council Member Bameich, and on the following roll call vote, to wit: AYES: Council Members Harmon, Barneich, Ray, and Brown NOES: None ABSENT: Mayor Hill The foregoing Resolution was adopted this 14th day of November 2017. WHITHAM, CITY ATTORNEY RESOLUTION NO. 4825 PAGE 4 EXHIBIT "A" CONDITIONS OF APPROVAL FOR STAFF PROJECT 17-010 "FUTURE CITY LEADERS" PUBLIC ART PROPOSAL GENERAL CONDITIONS: 1. This approval authorizes the installation of the "Future City Leaders" public art proposal on the eastern wall of the City Council Chambers as depicted in Exhibit"B". 2. Arroyo Grande Public Art shall ascertain and comply with all State, County and City requirements as are applicable to this project. 3. The art installation shall occur in substantial conformance with the application and plans on file in the Community Development Department. 4. Arroyo Grande Public Art shall comply with all of the Conditions of Approval for Staff Project 17-010. 5. Arroyo Grande Public Art shall agree to indemnify and defend at his/her sole expense any action brought against the City, its agents, officers, or employees because of the issuance of said approval, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fees which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. 6. Arroyo Grande Public Art shall provide all paint and protective materials for the mural. The City shall provide personnel for the preparation and protection of the mural surface. 7. The project's final design shall be submitted to the Architectural Review Committee for review and the Council be notified when the review meeting is scheduled.
