A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARROYO GRANDE APPROVING THE CITY'S STORM
WATER MANAGEMENT PLAN
WHEREAS, in 1972, the Federal Water Pollution Control Act, known as the Clean Water
Act (CWA) was enacted.
WHEREAS, the CWA established the baseline goal for attaining fishable, swimable waters
throughout the United States;
WHEREAS, in 1987, the CWA was amended to add Section 402, which established a
framework for regulating discharges from Municipal Sanitary Storm Sewer Systems (MS4s)
as a special category of point source discharge under the National Pollution Discharge
Elimination System (NPDES) program;
WHEREAS, in 1999, the EPA established the Storm Water Phase II Final Rule requiring
NPDES permits for municipal agencies, including the City of Arroyo Grande;
WHEREAS, the City submitted a Notice of Intent to comply to the Regional Water Quality
Control Board (RWQCB) on September 23, 2003;
WHEREAS, on February 15, 2008, the RWQCB issued a letter requiring Best Management
Practices to achieve four additional water quality protection conditions; and
WHEREAS, the City submitted a Storm Water Management Plan on June 20, 2008,
including provisions for low impact development and hydromod~cation.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Arroyo Grande
does hereby approve the Storm Water Management Plan (SWMP) contingent upon
resolution of the issues identified in staffs proposed comments to the Regional Water
Quality Control Board (RWQCB); as set forth in the letter to the RWQCB dated November
26, 2008.
On motion of Council Member Fellows,-seconded by Council Member Guthrie, and on the
following roll call vote, to wit:
