A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARROYO GRANDE APPROVING A ONE-YEAR TIME
EXTENSION FOR VESTING TENTATIVE TRACT MAP NO.
04-002 AND PLANNED UNIT DEVELOPMENT NO. 04-002;
APPLIED FOR BY CREEKSIDE ESTATES OF ARROYO
GRANDE, LLC FORA 9-ACRE PROPERTY LOCATED
EAST OF NOGUERA PLACE AND NORTH OF EAST
CHERRY AVENUE EXTENSION (CHERRY CREEK
PROJECT)
WHEREAS, the City Council approved Vesting Tentative Tract Map No. 04-002 and
Planned Unit Development No. 04-002 on November 28, 2006 to subdivide a nine (9)
acre property into thirty (30) single family residential units; and
WHEREAS, the City Council of the City of Arroyo Grande has considered a request for a
one-year time extension for Vesting Tentative Tract Map No. 04-002 and Planned Unit
Development No. 04-002; and
WHEREAS, the Governor signed SB 1185 into law on July 15, 2008, providing an
automatic one year extension for tentative maps that were valid and effective on that
date; and
WHEREAS, based on SB 1185, the Cherry Creek Project approval expires on
November 28, 2009; and
WHEREAS, the City Council finds, after due study and deliberation, that there have been
no significant changes in the General Plan, Municipal Code or character of the area within
which the project is located that would cause the approved project to be injurious to the
public health, safety, or welfare.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Arroyo
Grande approves aone-year time extension for Vesting Tentative Tract Map No. 04-002
and Planned Unit Development No. 04-002, with the above findings and subject to the
conditions as set forth in Exhibit "A" attached hereto and incorporated herein by this
reference.. Vesting Tentative Tract Map No. 04-002 and Planned Unit Development No:
04-002 shall now expire on November 28, 2010.
On motion of Council Member Fellows, seconded by Council Member Guthrie, and by the
following roll call vote, to wit;

9-ACRE PROPERTY LOCATED EAST OF NOGUERA PLACE AND NORTH OF EAST
CHERRY AVENUE ESTENSION (CHERRY CREEK PROJECT)
GENERAL CONDITIONS
This approval authorizes aone-year time extension for Vesting Tentative Tract Map No.
04-002 and Planned Unit Development No. 04-002, which was originally approved by the
City Council on November 28, 2006 to subdivide a 9-acre site into thirty (30) residential
lots.
The applicant shall ascertain and comply with all Federal, State, County and City
requirements as are applicable to this project.
2. The applicant shall comply with all conditions of approval for Vesting Tentative
Tract Map No. 04-002 and Planned Unit Development No. 04-002.
3. Vesting Tentative Tract Map No. 04-002 and Planned Unit Development No. 04-
002 shall automatically expire on November 28, 2010. The applicant may apply
for two (2) additional one-year time extensions, pursuant to Development Code
Section 16.12.140.
4. For all building permits issued in the subject development, the applicant shall pay
those development impact fees that are in effect at the time the building permits
are issued.
