(KRAETSCH) Recommended Action: Ratify the listing of cash disbursements for the period August 1, 2009 through August 15, 2009. Consideration of Approval of Minutes 8.b. (WETMORE) Recommended Action: Approve the minutes of the Special Meeting of July 28, 2009 and the Regular City Council/Redevelopment Agency Meeting of July 28, 2009. Consideration of Approval of a Memorandum of Understanding with the Lucia Mar 8.c. Unified School District for the Bright Futures Program (PERRIN) Recommended Action: 1) Approve a Memorandum of Understanding (MOU) with the Lucia Mar Unified School District for the Bright Futures After School Program; 2) Authorize the City Manager to sign the MOU; and 3) Authorize the City Manager to approve minor changes to the MOU determined to be consistent with the purpose of and beneficial to the program. Consultant Engineering Services for the Reservoir No. 6 and Oro Booster Station Upgrade Projects (STRONG) Recommended Action: 1) Approve a Third Amendment to the Agreement for Consultant Services with Wallace Group to increase the “not to exceed” amount by $39,500 to include landscape architectural, planning and construction support services as part of the Reservoir No. 6 and Oro B ooster Station Upgrade projects; and 2) Authorize the Mayor to execute the amendment. Consideration of Second Amendment to Agreement with Penfield & Smith for 8.e. Consultant Engineering Services (STRONG) Recommended Action: 1) Approve a Second Amendment to the Agreement for Consultant Services with Penfield & Smith to increase the “not to exceed” amount by $7,000 to include a detailed plan and profile for the storm drain and sewer plans, to modify the pavement rehabilitation strategy and storm drain configuration, and to include a pavement rehabilitation bid alternative as part of the West Branch Street Resurfacing capital improvement project; and 2) Authorize the City Manager to execute the amendment. Consideration of a Resolution Establishing Increased Parking Citation Fines to 8.f. Cover State and County Parking Violation Assessments (ANNIBALI) Recommended Action: Adopt a Resolution establishing the new parking fee schedule based on new State of California and County of San Luis Obispo parking violation fines. Consideration to Adopt a Resolution Declaring the Intention of the City Council of 8.g. Arroyo Grande to Grant to ConocoPhillips Pipeline Company, a Franchise to Construct, Operate, and Maintain Pipelines for the Transportation of Oil, and other Specified Materials, in the City of Arroyo Grande (CARMEL) Recommended Action: Adopt a Resolution declaring its intention to grant to ConocoPhillips Pipeline Company, a franchise to construct, operate, and maintain pipelinesfor the transportation of oil, and other specified materials, in the City of Arroyo Grande. 9.PUBLIC HEARINGS : Consideration of Appeal of Planning Commission’s Approval of Vesting Tentative 9.a. Parcel Map Case No. 05-001 and Minor Exception Case No. 05-006 to Subdivide a 1.28 Acre Parcel into Three (3) Residential Lots and Construct Two (2) Residences; Applicant – Deblauw Builders, Inc.; Location – 605 Eman Court (STRONG) Recommended Action: Adopt a Resolution denying the appeal and upholding the Planning Commission’s decision to approve Tentative Parcel Map No. 05-001 and Minor Exception No. 05-006. 10.CONTINUED BUSINESS: None. Honorable City Conneilmembers, I submit these comments on behalf of the Environmental Center of San Luis Obispo (1'C:;OS I..0) and the San Luis Obispo Coastkeeper, a project of Environment in the Public Interest. We are concerned that the City has tailed to comply with California Environmental Quality Act (CEQA) for reasons that 9 14 will be explained below. We urge the City to address these issues before considering the project for final approval. Background This project is an application to subdivide a 1.28 acre site into three parcels and authorize the construction of three single family dwellings on each created lot. The project site is immediately adjacent to the Arroyo Grande Creek and includes a portion of the creek channel. The surrounding neighborhoods include active farmland and residences. The steep creek banks are covered by riparian vegetation and provide habitat for California red legged frog (CRLF). The creek itself is known to contain the federally and state protected steelhead. The Mitigated Negative Declaration /Initial Study (MN D) admits that the project could result in various adverse environmental impacts, including erosion and landslide, water quality degradation, and adverse impacts on CRLF and steelhead, among others. Compliance with CEO% ECOSLO and the Coastkeeper are concerned that the City's review of this project is inadequate, incomplete and inconsistent with CEQA. In particular, the record shows that the City has (I) failed to adequately investigate the project's impacts on federal and state protected species, (2) failed to provide notice to the Department of Fish and Gann (DFCI), a 'trustee agency' within Page I the meaning of CEQA, and (3), proposed mitigation measures are not adequately fleshed out, are inadequate and could be potentially inconsistent. Based on the record as it stands today, we believe CEQA mandates the preparation of an Environmental Impact Report. 1. Section 4 of the MND explains that the project could impact the federally protected CRLF and the state and federally protected southern steelhead. Yet, there is no evidence in the record that the City has adequately considered the project's impacts on these species. In particular, there is no evidence that any biological surveys have been conducted relative to these species. CEQA requires the lead agency to describe the project's biological baseline and assess the project's likely impact on biological resources. CEQA requires that the lead agency to consider "the whole of the action." CEQA Guidelines §15378(a). Any part of a project that may result in a physical change to the environment must be analzed. 1 An initial study, therefore, must consider all phases of a project, including planning, implementation, and operation. CEQA Guidelines uso63(a)(0. The lead agency may not ignore any reasonably foreseeable impacts that are indirectly caused by a project. CEQA Guidelines 25064(d). Indirect impacts are defined as impacts that although, can be said to be caused by the project, are remote in time or distance. CEQA Guidelines 15o64(d)(2). As such, the impacts from human residence and occupancy in this future community may be defined as indirect impacts, and must therefore be analyzed, and if found to be potentially significant, mitigated. The City has violated CEQA because the MND fails to adequately (a) describe the biological baseline or (b) the project's likely indirect and cumulative impacts. 2. Before approving an MND or an EIR, a lead agency must provide notice of the project to all trustee and responsible agencies. DEC is a "trustee" agency within the meaning of CEQA by virtue of its jurisdiction over fish and wildlife, including CRLF and steelhead. CEQA Guideline §15386. T he City, therefore, was required to provide notice to and consult with DEG in connection with the project's potential impacts on CRLF and steelhead. Pub. Res. Code §21080.3(a): Gentry v. City of Murieta (1995) 36 Cal.App.4th 1359. The City has violated CEQA because there is no evidence in the record that DEG or the U.S. Fish and Wildlife Service or National Oceanic and Atmospheric (NOAA, which has jurisdiction over anadromous'fish such as the steelhead) were provided notice of this project. I'aee 3. The MND proposes a series of potentially conflicting and inadequate mitigation measures to address a variety of project impacts. Mitigation Measures (MM:) 4.2t is intended to address the potential impacts to steelhead and its habitat due to indirect impacts to the Creek. This MM, however, does not adequately address those indirect impacts. Instead, MM4.n only forbids removal of riparian or upland shade trees and requires planting of riparian trees along the creek. The MND fails to identify or analyze the project's potential indirect impacts on steelhead or to require adequate measures to address those impacts. A last minute addition to the MND now requires that a final landscape plan be prepared by a professional biolog'at and submitted to the City for consideration. The City now also proposes to submit. the landscape plan for review by "responsible agencies" such as the "Central Coast Salmon Enhancement (CCSE] and Resource Conservation District [RCM". While we support sharing information with both CCSE and RCD and believe their input: would be valuable, we must point out these organizations are not considered "responsible agencies" under CEQA. We urge the City to submit the landscape plan and solicit response from DEG. USFWS and NOAA. Moreover, we do not believe a future landscape plan by a biologist satisfies CEQA's prohibition against deferral of mitigation measures. Where practical considerations prevent formulation of mitigation measures early in the planning process, the agency can commit itself to eventually devising measures that will satisfy specific performance criteria articulated at the time of project approval. CEQA Guideline §1.5126.4(a)(1)(B). Hem, the City has not articulated any performance criteria, or explained why the landscape plan could not have been made prepared and made available for public review before the project is approved. Elsewhere, Section 14 of the MND also acknowledges that construct and post construction uses at the cite could degrade water quality and indirectly impact "sensitive species," presumably steelhead and CRLF. MM.14.1 purports to address these unexplained impacts by reducing erosion hazards due to construction activities by minimizing grading, use of runoff and sediment control structures and /or establishing a permanent plant cover on side slopes or land cleared of vegetation following construction. The problem with this MM is that it does not describe appropriate runoff and sediment control structures, or specifically require the establishment of a permanent plant cover on the slopes, and does not specify the type of vegetation that may be used to provide the cover. The developer may elect not to establish a plant cover on the slopes, or to use invasive species, which may result in adverse impact on local native species or be harmful to the CRLF. Page -3- This MM is inadequate in that it does not adequately define the mitigation measure and does not specify any performance standards. The MND makes no effort to consider which plant species should be used to avoid impact on native or endangered species. In this regard, we note that Section 4 of the MND recognizes that the project may "substantially degrade the riparian corridor associated with Arroyo Grande indirectly through introduction of exotic /invasive non native plant species," but MM4.3 does not address this potentially significant impact.. Accordingly, we believe it is important for the MND to discuss appropriate plant species for this site before the project is approved. Conclusion For all these reasons, we believe th9 City should postpone consideration of this project and its final approval until the issues identified in this letter are resolved. As things stand, because it can be fairly argued that the project may result in significant adverse impacts on the environment, the City may not approve the project before it has prepared and certified an Environmental Impact Report.
