, ARROYO GRANDE, CALIFORNIA 1 :00 P.M.
The City Council met in continued public meeting, Study Session with Mayor
B'Ann Smith presiding, to discuss Walnut View Estates. Upon roll call, Council
Members Dorace Johnson and Gene Moots were present; Council Members Matt Gallagher
and D. G. Porter were absent.
Mayor Smith asked Planning Director Stan Elsner to make a presentation of what
transpired at the last meeting regarding the lot Split of Walnut View Estates.
Council Member Porter arrived at 1:08 P.M. and is now present.
Mr. Eisner said the proposal is to divide the 16 acre property into four specific
parcels, and demonstrated on a posted map the boundaries of the property. He said the
Planning Commission had approved the requested lot Split, and read the four require-
ments that were put on the Parcel Map, outlined in his memo of February 21, 1985.
Council Member Gallagher arrived at 1:15 P.M. and Is now present.
Mayor Smith reminded Council they were In a Study Session and that no decisions
needed to be made until the next regular Council meeting. She asked what the options
are for Council. City Attorney Shaw said the concept that the present zoning really
means that the parcel map is dividing the property for agricultural purposes; or the
Council could go the other way and split it into three or four parcels and consider
rezoning it for agriculture only. He said he thought the Council was looking at a
piece of property which is zoned for higher density and being split up with the
obvious fact that if the split is allowed now, and the owner sells off some parcels,
it can be further split. He said either It is appropriate to split it as requested,
which indicates permanent agricultural usage, or It is appropriate to say this does
not fit your present zoning and have the owner come back with something that does.
Public Works Director Paul Karp said he thought Council should make a finding
that the improvements required are necessary prerequisites for the orderly develop-
ment of the community or for public health and safety, if and when the map is
approved.
Council Member Gallagher brought up for discussion the fact that the Soils Map
classifies the land as Class II land, which is not a renewable resource If it is
put into general development, and is not compatible with adjoining properties. He
said the land use of the General Plan is not in concert with the map, and that
Council should look at the idea of changing the zoning so it would be in conformity
with the land Use Map. He said he thought the drainage plan should be prepared and
submitted, and that COuncil should determine if the present zoning is correct; and
he agreed that rather than a reservation on either side of the centerline it should
be dedication to the City.
Council Member Moots said he did not understand putting the property into four

Mayor Smith asked if the improvements had to be made with the lot split or after
recordation of the map. Mr. Karp said the Map Act states that the improvements have
to be completed prior to, or bonded for with an agreement to complete same, within a
reasonable time after the recordation of the Map.
City Attorney Shaw said no grading or improvements should be done until the
Parcel Map has been recorded.
Council Member Johnson said she could not see why smaller lots would be
preferable to one large parcel, and that she felt the property should not be anything
but agriculture.
Council Member Porter said several things bothered him and one is the dedica-
tion of the street, with the offset on two sides of the Marsalek property, which
poses a safety problem at the narrow portions. He said the national standard set
by the Department of Agriculture should be a guide; and submitted Summary Charts
for all soils in Arroyo Grande, along with a Scenario for Class I Ag land in five
acres plus parcels. He said he did not like splitting the property, and he did
not like the drainage plan because the plan is to divert the water. Counci I Member
Johnson agreed the drainage plan is not a satisfactory solution.

Council Member Gallagher asked if there is a time limit placed on the applicant
for recording the deeds. Mr. Shaw said the time period is two years, and there is
usually an extension granted'of an additional two years. If the Final Parcel Map
is not recorded prior to expi"ration of the approval, a new Tentative Map must be
submitted.
Mayor Smith suggested Council and Staff should gather pertinent information
regarding soil classifications, zoning, lot sizes, how many properties within the
City are prime ag land zoned other than Class I or Class II and already developed.
Council Member Porter submitted documents to be entered into the record, and
to have copies distributed to Council and Staff (Scenario for Class I Agri Land in
Large Parcels, and Summary Charts for all Soils in Arroyo Grande).
Mr. Eisner explained the reasons for the Planning Commission's decision on the
requirements for sidewalks and said that sidewalks become an issue when lot sizes
of one acre or smaller are considered.
Mayor Smith asked if anyone in the audience wanted to address comments to the
Counc i I .
FRED SCHOTT, Engineer, asked about the sidewalks discussed, and commented the
sidewalks were of no use to anybody and have no value, no need, and no place to go.
C. KUREK, 603 East Cherry Avenue, asked about the legality to divert water to
a natural channel. Mayor Smith said she assumed it could be diverted as long as
the diversion takes care of the water as it enters another property, and can flow
on without damaging someone else.
ELLA HONEYCUTT, 560 Oak Hill Road, said the farmers in the area are very
concerned and would like to be informed about any meetings being scheduled.
Mayor Smith adjourned to Closed Session at 2:10 P.M. to discuss the subject
of Personnel.
Council reconvened from Closed Session at 3:12 P.M. On motion of Council Member
Gallagher, seconded by Council Member Johnson, and unanimously carried, to adjourn
to Regular Session on, March 12, 1985. Council adjourned at 3:15 P.M.
