Minutes 1983-09-27 "\ j CITY COUNC' L SEPTEMBER 27, 1983 ARROYO GRANDE, CALIFORNIA 7:30 P.M. The City Council met in regular session with Mayor Smith presiding. Upon roll call, Council Members Lawrence Vandeveer, Matt Gallagher, Mark Millis were present, Karl A. Hogan was absent. PLEDGE OF ALLEGIANCE AND INVOCATION Counci I Member Gallagher led the Pledge of Allegiance to our Flag. Reverend Larry Waggoner, Grace Bible Church, delivered the invocation. APPROVAL OF MINUTES After correction of a typographical error on page 5, a motion was made by Councilman Millis, seconded by Councilman Gallagher, and unanimously carried, the minutes of the September 13, 1983, meeting were approved as corrected. APPROVAL OF CHECKS On motion of Councilman Gallagher, seconded by Councilman Millis, and unani- mously carried, Demand Checks Nos. 20822 through 20884, in the total amount of $52,400.61; and Payroll Checks Nos. 25865 through 25955, in the total amount of $67,636.97, were approved for payment as presented by Finance Director David Bacon. INSTALLATION ANO ELECTRICAL CORRECTIONS REQUIRED FOR EXTERIOR LIGHTING AT FIRE STATION . City Manager Mack said that in accordance with Council's direction to determine if a val id warranty existed on the electrical system at the Fire Station, Fire Chief Tony Marsalek had found that the warranty was in effect for one year and now expired, and assured Council that contractor had done everything he was supposed to at the time of installation. Chief Marsalek said it is necessary to Install a photocell and relays and that bids have been received for the project. A motion was made by Councilman Vandeveer, seconded by Councilman Hogan, and unanimously carried,~o accept the bid of Dave's Electric in the amount of $540.00 . to install a photoceJ , relay, and flood light for flagpole at the new Fire Station:) ----./'AWARD OF BID RE SECURITY SYSTEM AT FIRE' STATION City Manager Mack said proposals had been received covering labor and materials to install a security system at the Fire Station; and recommended approval of the. bid by Automatic Alarms in the amount of $1685,.00. He also suggested that after a period of evaluation of the system, it might then be considered for City Hall. Not included in the $1685 figure, Is an additional $75.00 to tie-In the existing fire alarm system, for a grand total of $1760.00. A motion was made by Councilman Millis, seconded by Councilman Hogan, and unanimously carrled,(to accept the bid of Automatic Alarms in .the amount of $1760.) CONTINUATION - DOWNTOWN PARKING ASSESSMENT FEES Mr. Mack said he had not been able to obtain all the documentation to provide .. the City Attorney factual information for necessary determinations; therefore, he requested this item be continued on the Council Agenda. . On motion by Councilman Ga1lagher, seconded by Councilman Mi1lis, Council agreed to continue the item until the next meeting. SOTO SPORTS COMPLEX LONG-RANGE PLAN - REQUEST FOR JOINT MEETING City Manager Mack asked Council to consider meet.iog i hour earlier than the norma I meet i ng time on October II,. to schedule a joint meeting with Parks and Recreation Commission and Messrs. Taylor and Schott, of the firm preparing the long-range plan for the Soto Sports Complex. After Council discussion, Council agreed to schedule the meeting requested from 6:30 P.M. to 7:30 P.M., Just prior to the regular session of the City Council on October 11, 1983. -'1 PUlIll~ HE~.RHIG RL APPEAL BY BANK OF AMERICA (lARCHMONT ORIVE IMPROVEMENTS) Public Works Director Karp,said the requirments for curbs, gutters and side- walks on the south side of larchmont Drive are based on the general Ordinance and an action by the City Council on"Sept. '14,1971; and he recommended that the Council uphold Its previous decision to require curbs, gutters and sidewalks on the south side of Larchmont Drive, adjacent to all commercial frontages to afford positive control of drainage and help control traffic adjacent tdl the steep bank, Mayor Smith said. the Public Hearing had been duly published and all require- ments met and the Public Hearing was opened. KEN MaciNTYRE, of Ross-levin-Maclntyre Architects, representing the Bank of America, passed a set of photographs to the Council of the site plan, which has four frontages. Three of the frontages will have curbs, gutters, sidewalks, street lights, and landscaping but the BofA is appealing the improvements on larchmont Drive. WALT PERAZZO, Bank of America, said over the past several months they have worked with the Planning Commission, redesigned the site, redesigned the building, upgraded materlals,all of which have added monitoring impact to the project. He said no present improvements had been made on Larchmont; customers of the B of A would not be using larchmont, and therefore curbs, gutters, sidewalks and conformed paving should not be required. After Council discussion, a motion was made by Councilman Millis, seconded by Counci.lman Gallagher, to(deny the appeal of Bank of America and uphold City design standards for commercial propert~ Councilman Hogan voted against the denial but the motion carried. RESOLUTION ADOPTING NEW AND REVISED CONSTRUCTION STANDARDS, OCTOBER 1983 . Publ ic Works Karp said the Counci I is requested to adopt the construction standards for the City each year at this time. There are only two new construction I standards as well as revisions to. existing standards listed on Public Works memo of' September 21, 1983. New Standard No. B9 outlines wheelchair ramp. requirements; Standard No. D6 is proposed to suggest to various engineers acceptable alternatives for concrete drains depending on their calculated design flows. A Resolution was presented to Council. Counci lman Hogan requested detai Is of eac:h, and Mr. Karp said he would bring the details to the next meeting in booklet form, for Council discussion before acting on the Resolution to adopt the Construction Standards. ADOPTION OF RESOLUTION RE. NO LEFT TURN FROM MID+STATE BANK Public Works Director Karp said the Resolution for no left turn onto Grand Avenue from the Mid-State Bank exits had been prepared and ready for Council adoption. The I ega 1 i ty of the action was questioned and City Attorney Shaw will check further, but advised that by adopting the Resolution it. would enable the City to put up the necessary signs, and he will research the action of citing offenders. Mr. Karp read the title of the Resolution. On motion by Councilman Gallagher, seconded by Councilman Vandeveer, and unanimously carried, to dispense with further reading of the Resolution. RESOLUTION NO. 1722 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE ESTABLISHING A POLICY TO PROHIBIT LEFT TURNS ONTO GRAND. AVENUE FROM THE PROPERTY AT 1026 GRAND AVENUE, MID+5TATE BANK. MEMO OF UNDERSTANDING City Manager Mack said the Resolution adopts a Memorandum of Understanding e~tablishing new wage and fringe benefits for Police Department employees during fiscal year 1983-84. Mr. Mack read. the title of the Resolution and on motion by Councilman Gallagher, seconded by Councilman Vandeveer, and unanimously carried to dispense with further reading of.the Resolution. ORDINANCE ADOPTION ESTABLISHING CITY'5 GENERAL MUNICIPAL ELECTION DAY City Manager Mack said an Ordinance was prepared and ready for Council's consideration relating to establishing the Statewide General Election Day as the City's General Municipal Election Day. Mr. Mack. read the t it I e of the Ordinance and a motion was made by Councilman Vandeveer, seconded by Councilman Gallagher,. unanimously carr.ied to dispense with further reading of the Ordinance. ORDINANCE NO. 299 C.5. AN ORDINANCE OF THE CITY OF ARROYO GRANDE AMENDING TITLE 2 OF THE ARROYO GRANDE MUNICIPAL CODE BY ADDING CHAPTER 9 THERETO RELATING TO ESTABLISHING THE STATEWIDE GENERAL ELECTION DAY AS THE CITY'S. GENERAL MUNICIPAL ELECTION DAY. ADEQUATE SERVICE LEVEL REQUIREMENTS City Manager Mack said the City has problems in providing adequate service to two' areas of the City and both of them are development related. They are in the Building Inspection Department and the Planning Department. Mr. Mack said there may be an increase of activity in the near future, which is already at a considerable I eve I. Mr. Mack said he is concerned about establishing permanent manpower levels. He proposed a second position be created in Building Inspection, and open up the position to application from employees within the Building Department. There are a number of priorities in the Planning Department, such as housing element, that will suffer If another position is not created to assist with the work load. He suggested a contract employee position for a period .of One year. The position' would be reevaluated after one year and',the contract renewed or terminated. Council endorsed Mr. Mack's recommendations and directed him to proceed. and report the progress back to the Council. ___~IMPROVEMENTS RE. PARKING SPACES AT FORMER BLOCK HOUSE SITE City Manager Mack said the Parking Advisory Board had recommended the creation of ei9ht new p'arking spaces where the old Block House had been, according to the diagram presented to Council. Some people in the Village area have said they preferred that none of the grassed area hor:.the"Ught standard be removed, and the recommendation of the Board was revised. After Council discussion, a motion was made. by Councilman Gallagher, seconded by Councilman Vandeveer,tot:pprove the original plan of the Parking Advisory Board on 7/12/83,)and on the following roll call vote, to wit: AYES: Councilmen Vandeveer, Gallagher, and Hogan NOES: Councilman Millis and Mayor Smith ABSENT: None the motion carried to create the eight new parking spaces. RESOLUTION BY CITY OF SAN LUIS OBI5PO(INCLUDING CENTRAL COAST CIII[~) TO GET A CONSTITUTIONAL INITIATIVE LIMITING AND RESTRICTING THE STATE RE. LAND USE City Manager Mack said a Resolution prepared by the City of San Luis Obispo including all.cities in San Luis Obispo County urging the Lea9ue of California Cities to develop and sponsor a California Constitutional Initiative restoring and guaranteeing local control of all final Land Use, Subdivision and Annexation approvals for privately owned property. After Council discussion, a motion was made by Councilman Vandeveer, seconded I by Councilman Gallagher and unanimously carried, to support the resolution and I allow Mayor Smith to sign for the City of Arroyo Grande. r I \' WRITTEN COMMUNICATIONS - None. _____n__'______ ------- ~-,_._-- CITY COUNCIL SEPTEMBER 27, 1983 ARROYO GRANDE, CALIFORNIA PAGE FIVE. ORAL COMMUNICATIONS Counci Iman Mi 11 is said the Harvest Festival had changed over the years and he felt one of the reasons was the open drinking of alcoholic beverages and felt the ordinance against it should be more strictly enforced. He also mentioned better control is needed in controlling the amount of trash generated by the crowds. Mayor Smith said there would be additional police patrols on duty, and that arrangements had been made for more trash bins, and for a Cub Scout group, who will be active on friady and Saturday to keep the trash under better control. Councilman Millis said there are continuing concerns with traffic problems in Arroyo Grande on Grand Avenue and, particularly, in the area of Oak Park Road and Highway 101, and suggested some ideas for correction. Mayor Smith said that the Staff from all the surrounding Cit'ies and CalTrans were scheduled to meet and work on the problems. City Manager Mack reported the annual fee for the State Vehicle Tires is $40.00, but the savings is considerably more.
