O 334 C.S. . ., . .. ORDINANCE NO. 334 C.S. AN ORDINANCE OF THE CITY OF ARROYO GRANDE AMENDING THE MUNICIPAL CODE TO REQUIRE THE INSTALLATION OF AUTOMATIC FIRE SPRINKLERS IN ALL NEW CONSTRUCTION. THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE DOES ORDAIN AS FOLLOWS: SECTION 1: The Municipal Code is amended by adding Title 4, Chapter 16 as follows: Chapter 16. Automatic Fire Sprinkler Systems Section 4-1&.01. Notwithstanding any provision to the contrary in the Uniform Fire Code or in any other applicable Codel automatic fire sprinkler systems shall be installed and maintained in all new construction. The total floor area of such buildings shall be computed without regard to separation walls and floors of less than four hours unpierced fire resistive construction. Section 4-16.02. The term "automatic sprinkler system/' as used hereinl is defined as an integrated system of underground and overhead piping, including a water supply such as a gravity tankl fire pump, reservoirl pressure tankl or connection by underground piping to a public mainl said system complying in all respects with the requirements for such systems contained in appropriate standards issued by the National Fire Protection Association. No automatic sprinkler system required by this Ordinance shall be installed without prior appro- val by the Fire Chief of the plans for installationl testing and maintenance of the system. Section 4-16.03. Subject to the approval of the Fire Chiefl sprinklers may be omitted from buildings where sprinklers are considered undesirable due to the nature of the contents, or in rooms or areas which are of non-combustible construction with non-combustible contents. Section 4-15.04. Variances to this Ordinance may be granted after a hearing by the Fire Chiefl Building Official and member of the building industry appointed by the City Council. Section 4-16.05. The application of Sections 4-15.011 4-15.02 and 4-15.03 shall not pro- hibit the exercise of the Substitution Option granted in the Uniform Building Code relating to "Fire Resistive Substitution." Section 4-15.06 If any provision of this Ordinance is for any reason held to be invalid by a court of competent jurisdiction, the Arroyo Grande Fire Department hereby declares that it would have passed each and every remaining provision irrespective of such holding in order to accomplish the intent of this Ordinance. -------.---,-.- , . . . SECTION 2: This Ordinance shall be in full force and effect thirty (30) days after its passage, and within fifteen (15) days after its passagel it shall be published oncel together with the names of the Council Members voting thereonl in a newspaper of general circula- tion within the City.
