O 322 C.S. j' / ORDINANCE NO. 322 c.s. AN ORDINANCE OF THE CITY OF ARROYO GRANDE AMENDING THE ARROYO GRANDE MUNICIPAL CODE BY AMENDING TITLE 9, CHAPTER 4, SECTION 9-4.3106(a) RELATING TO "APPEALS". THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE DOES ORDAIN AS FOLLOWS: SECTION 1: That Section 9-4.3106(a) of the Arroyo Grande Municipal Code is amended to read in its entirety as follows: Sec. 9-4.3106. Appeals. Any person, including elected and appointed City officials, may appeal to the Council any order, requirement, decision, or determination of the - Commission in the manner set forth in this Section. (a) Appeals shall be made in writing and filed with the City Clerk, together with a filing fee in the amount of Fifty and no/l00 ($50.00) Dollars, within ten (10) days after the final action of the Commission. The fj I in9 fee shall be waived for an appeal of a City elected or appointed official acting in such capacity. Upon the receipt of an appeal, the City Clerk shall set a time, within thirty (30) days after the receipt of such appeal for a public hearing on such appeal. Notice of such hearing shall be given as set forth in Article 33 of this chapter. The City Clerk shall also notify the Commission of such appea 1 . In the event the City's expenses, including legal notices, are less than the filing fee, any amount of the filing fee not expended by the City shall be refunded to the applicant. SECTION 2. This Ordinance shall be in full force and effect thirty (30) days after its passage, and within fifteen (15) days after its passage, it shall be published once, together with the names of the Council Members voting thereon, in a newspaper of general circulation within the City.
