AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE MODIFYING TITLE 9, CHAPTER 4 OF THE MUNICIPAL CODE BY ADDING ARTICLE 40, STANOARDS AND CONDITIONS FOR SECOND DWELLING UNITS IN SINGLE FAMILY RESIDENTIAL ZONES: AND RELATED MODIFICATIONS TO ARTICLES 5, 6 AND 26. ARTICLE 40. STANDARDS FOR SECOND RESIDENTIAL DWELLING UNITS. Section 9-4.4001. Purpose. The purpose of this article is to regulate the establishment and maintenance of second residential dwelling units in R-l and R-A Zones. Section 9-4.4002. Definitions. For purposes of this article, the following definitions shall apply: (a) Second residential dwelling unit shall mean a rental unit consisting of complete, independent, permanent facilities for living, sleeping, eating, cooking and sanitation, and located on land zoned for a single-family dwelling in the R-l and R-A Zones, (b) An "attached second dwelling unit" shall mean a dwelling unit which is either combined within the living area of or attached to the primary resi- dence: a "detached second dwe 11 i ng un it" sha II mean a dwe II i ng un i t wh i ch is not combined within or attached to the primary residence. For the purpose of this Article, "dwell ing unit" sha1l not include a garage or any accessory structures. (c) Primary residence shall mean an existing detached residential structure that conforms with all applicable zoning regulations. Section 9-4.4003. Use Permit Required. Second residential dwelling units as defined herein may be permitted in R-1 and R-A Zones subject to obtaining a Use Permit as provided In Section 9-4.310 of this Chapter and as otherwise provided in this Section. No vari- ances for second units will be granted. Section 9-4.4004. Development Standards. (a) All construction shall comply with current existing building codes, architectural review criteria and single family zoning regulations, i nc 1 ud i rig , but not limited to, setbacks, height limits and maximum lot coverage. (b) Second units will not be permitted on lots with more than one existing single familY dwelling. For "attached" second units a minimum lot size of 6,000 square feet shall be required; for "detached" second units a minimum lot size of 12,000 square feet shall be required. Such "detached" un i t sha II also be located at least 20 feet from the primary residence. (c) Gross floor area of a second unit shall not exceed 640 square feet. Not more than one bedroom per second unit is permitted. (d) Second units shall be prohibited on lots containing a guest house, converted garage or mobile home. (e) Off-street parking shall be provided by one covered and one uncovered parking space, exclusive of front and exterior sid~ yard setbacks, in addition to the minimum number of parking spaces pursuant to Article 26 of this Chapter. Section 9-4.4005. Occupancy Requirements. (a) Occupancy of second units shall be limited to a maximum of two (2) persons. (b) Second units shall not be offered for sale, and shall be occupied as a primary residence for a period not less than thirty (30) days. For establishing conditional use criteria, the Director shall consider the adequacy of water, sewer, drainage, fire and emergency services, and the impact of additional dwelling units on traffic flow. Section 9-4,4007. Deed Restriction Required. A deed restriction shall be recorded against the title of the property containing a second unit. Such deed restriction shall stipulate the use of the second unit for rental purposes only; owner-occupancy of the premises; and maximum occupancy of the second unit by two (2) persons. AMEND TITLE 9, CHAPTER 4 AS FOLLOWS: Add to Article 5. Residential Agriculture, Section 9-4.502. Uses Permitted (R-A). (e) One noncommercial guest house, except where there is an existing second residential dwelling unit; and to Section 9-4.503, Uses Permitted Subject to Obtaining a Use Permit (R-A). (f) Second dwelling units as provided in Article 40 of this Chapter. Add to Article 6. Single Family Residential, Section 9-4.603. Uses I Permitted Subject to Obtaining a Use Permit (R-I), (d) Accessory buildings used as guest rooms provided no cooking facility is installed or maintained, and except where there is an existing second residential dwelling unit; (g) Second dwelling units as provided in Article 40 of this Chapter. Add to Article 26. Off-Street Parking Requirements. Section 9-4.2602. Minimum Requirements. Second Residential One Covered and One Uncovered Dwell ing Units Parking Space Per Unit This Ordinance shall be in full force and effect thirty (30) days after I its passage, and within fifteen (15) days after its passage, it shall be published once, together with the names of the Council Members voting thereon, in a newspaper of general circulation within the City.
