RESOLUTION NO. 3273
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ARROYO GRANDE CONSENTING TO THE
TRANSFER OF CONTROL OF THE NON-EXCLUSIVE
CABLE FRANCHISE FROM SONIC CABLE TELEVISION
OF SAN LUIS OBISPO TO CHARTER COMMUNICATIONS
WHEREAS, FCC Form 394 Application for Franchise Authority Consent to
Assignment or Transfer of Control of Television Franchise was filed on or about
September 19, 1997 and said application requested transfer of control of the
current cable television franchise from Sonic Cable Television of San Luis
Obispo to Charter Communications.; and,
WHEREAS, the City, as the local franchise authority, has conducted a review
and investigation into the legal, financial, and technical qualifications of Charter
Communications to control the operations of the cable television system in light
of the above-referenced FCC Form 394; and,
WHEREAS, all written comments and staff reports have been received and
made a part of the record; and,
WHEREAS, following review, investigation, and due deliberation, the City has
concluded that Charter Communications has established that it meets the legal
criteria to control the operation of the cable television franchise and has satisfied
all criteria set forth in and/or under all applicable or required local franchise
authority and federal documents, laws, rules, and regulations, including FCC
Form 394.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Arroyo
Grande that it gives its approval to the transfer of control of the cable television
franchise to Charter Communications in accordance with FCC Form 394.
On motion of Council Member Lady , seconded by Council
Member Runels , and on the following roll call vote, to wit:
AYES: Council Members Lady, Runels, Tolley, Fuiler, and Mayor Dougall
NOES: None
ABSENT: None
