R 4315 RESOLUTION NO. 4315 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE ADOPTING A MITIGATED NEGATIVE DECLARATION AND APPROVING CONSTRUCTION DOCUMENTS AND SPECIFICATIONS FOR RESERVOIR #6 AND THE ORO BOOSTER STATION UPGRADE WHEREAS, the City Council has considered the recommendations of the 1998 Water Master Plan to provide adequate water supply and storage facilities; and WHEREAS, the City Council has considered the recommendations of the August 1, 2008 Preliminary Analysis Pressure Zone Connection Rancho Grande to Oro Zone to construct a new 250,000 gallon water reservoir adjacent to Reservoir #3, Stagecoach Road, Arroyo Grande to provide adequate water storage facilities; and WHEREAS, the City Council finds that this project is consistent with the City's General Plan, Development Code and the environmental documents associated therewith, and has reviewed the draft Negative Declaration with mitigation measures under the provisions of the California Environmental Quality Act (CEQA); and WHEREAS, the City Council finds these improvements are necessary to ensure that public health and safety standards will continue to be met in the future; and WHEREAS, the City Council finds the Mitigation Monitoring Plan in compliance with California Environmental Quality Act requirements under CEQA Section 15097; and WHEREAS, the City's property located at Stagecoach Road, Arroyo Grande, California, (Assessor Parcel 047 - 126 -010) is and has been used as water facility for the purposes of storing water; and WHEREAS, the City Council finds that on the basis of the Initial Study and all the comments received, there is no substantial evidence that the project as conditioned will have a significant effect on the environment. The potential impacts can and will be mitigated to a less than significant level and comply with California Environmental Quality Act requirements under CEQA Guidelines Section 15070; and WHEREAS, the City Council finds, after due study, deliberation and public hearing, the following circumstances exist: FINDINGS FOR APPROVAL 1. The proposed use is permitted within the subject land use categories and complies with all the applicable provisions of title 16, the goals, and objectives of the Arroyo Grande General Plan, and the development policies and standards of the Municipal Code. RESOLUTION NO. 4315 PAGE 2 The construction of a 250,000 gallon steel water tank is consistent with and meets all pertinent Municipal Code development standards. 2. The proposed use would not impair the integrity and character of the land use in which it is to be established or located and as conditioned, the project will not impair the integrity and character of the residential neighborhood. The proposed water storage facility is similar in character, scale and function to the Reservoir #3. 3. The site is suitable for the type and intensity of use or development that is proposed. The site is suitable for the construction of a 250,000 gallon water storage facility based upon the development standards of the Municipal Code. 4. The proposed use will not be detrimental to the public health, safety or welfare or materially injurious to properties and improvements in the vicinity. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Arroyo Grande hereby adopts a Mitigated Negative Declaration; and approves the Construction Plans and Specifications for Reservoir #6 and the Oro Booster Station Upgrade.
