the next one -year period, pursuant to Council policy.

R ECOMMENDATION:
It is recommended that the City Council adopt a resolution accepting the Certificates of
the County Clerk certifying the results of the canvass of all votes cast November 2
2010 at the Consolidated General Municipal Election, City of Arroyo Grande.
FINANCIAL IMPACT:
CT:
There is no fiscal impact associated with the recommended action. The City has not yet
received an invoice from the County of San Luis Obispo for the costs to conduct the
election; however, the estimated costs provided by the County for the 2010 General
Municipal Election are included in the FY 2010 -11 Legislative and Information services
Department Budget.
BACKGROUND:
On November 2, 2010, a General Municipal Election was held in the City for the
purpose of electing a Mayor and two 2 City Council members, and voting on two 2
ballot measures ( "Measures C -1 0 and D -1 " asking voters if the City Clerk and City
Treasurer positions should be changed from elective to appointive. The City's election
was consolidated with the statewide General Election and conducted by the San Luis
Obispo County Clerk-Re The County Clerk-Recorder was responsible for
canvassing all votes cast and certifying the election results.
ANALYSIS OF ISSUES:
Total voter registration for the City of Arroyo Grande was 11,059. The number of total
ballets east was 8,119 resulting in a 73.42% voter turnout. Results of the election are as
follows:

Mayor (Vote for j):
Tony Ferrara received 5,434 votes (76.78%). Timothy J. Moore received 1,,596 votes
( 22.55%).
City Council (V for Q
Of the four City Council member candidates, the two who received the highest number
of votes were Joe Costello ,151; 37.54%) and Tim Brown (8,426; 30.98%). Shannon
Kessler received 1,839 rotes (16.63%), and Heidi Lauren ano received 1,602 votes
(14.49%).
Measures:
Measure C-10 passed by 58.74 %, which met the majority voter approval required for
changing the City Clerk position from elective to appointive. Therefore, from and after
November 6, 2012, or upon earlier vacancy in the office of the City Clerk, the City Clerk
shall be an appointive position.
Measure D -10 passed by 88.94 %, which met the majority voter approval required for
changing the City Treasurer position from elective to appointive. Therefore, from and
after November ber , 2012 or upon earlier vacancy in the office of the City Treasurer, the
City Treasurer shall be an appointive position.
On June 8, 2010, when the Council adopted Resolution fro. 4293 (Attachment 1 ) adding
the measures to the ballot, the Council also directed staff to place on a future agenda
an ordinance to delegate appointment authority to the City Manager if the measures
were approved by a majority of voters. Staff will be bringing forward a proposed
Ordinance to Council at a regular meeting in January which will allow the Council to vest
in the City Manager the authority to appoint the City Clerk and City Treasurer in the
future.
In conclusion, the County Clerk-Recorder has conducted the official canvass of the
returns of the rotes oast in the election and has certified the results, as shown in Exhibit
A of the attached Resolution. Adoption of the Resolution will accept the County Clerks
Certificate of the official election results.
ALTERNATIVES:
The following alternatives are provided for the Councils consideration:
1. Approve staffs recommendations;
2. Do not approve staff's recommendations; or
3. Provide direction to staff.

2010 CONSOLIDATED GENERAL ELECTION
WHEREAS, a Consolidated General Municipal Election was held in the city of Arroyo
Grande, California, on Tuesday, November 2, 2010 as required by law; and
WHEREAS, included on the ballot for the city of Arroyo Grande General Municipal Electron
was one 1 Mayor for a full terra of 2 years, two 2 city Council Members for a full terra of
years, and two 2 measures (Measures C -10 and D-1 0); and
WHEREAS, the results of the canvass of all votes cast at the Consolidated General
Election held on lovernber 2, 2010, has been certified by the county .C. lerk- Record er and is
attached and incorporated herein as Exhibit A.
Not, THEREFORE, BE IT RESOLVED by the city Council of the City of Arroyo Grande
that:
1. That the whole number of ballots cast in the city was 8,119.
2. That the names of the persons voted for at the election for Mayor were: Tony
Ferrara and Timothy J. Moore.
3. That the names of the persons voted for at the election for council Member were:
Joe Costello, Shannon Kessler, Tim Brown, and Heidi Lauren an .
4. That the Measures voted upon at the election were as follows:
Measure C-10: Shall the office of City Clerk be appointive'
Measure D-10: shall the office of City Treasurer be appointive?
5. That the City council does declare and determine that as a result of the election:
o Tony Ferrara was elected as Mayor for a full term of two 2 years;
o Joe Costello was elected as city Council Member for a full terra of four 4
years;
o Tian Brown was elected as City council Member for a full term of four 4 years;
o A majority of voters awrov d Treasures C-10 and D-10;
6. That the City council of the City of Arroyo Grande does hereby accept the
Certificates of the County clerk- Results of Canvass of All votes cast at the
November 2, 2010 consolidated General Election, attached hereto as Exhibit A and
incorporated herein.

7. The city clerk shall immediately make and deliver to each of the persons so elected
a certificate of Election signed by the City Clerk and authenticated; that the city
Clerk shall administer to each person elected the Oath of Office prescribed in the
Constitution of the State of California and shall have then subscribe to it and file it in
the Office of the City Clerk. Each and all of the persons so elected shall then be
inducted into the respective office to rhich they have been elected.
8. The City Clerk shall certify to the passage and adoption o f this Resolution and eater
it into the Book of Original Resolutions.

GRANDE ORDERING THE SUBMISSION To THE QUAUFIED VOTERS
OF THE CITY MEASURES RELATING To THE CITY CLERK AND CITY
TREASURER POSITIONS AT THE GENERAL MUNICIPAL ELECTION
To BE HELD ON TUESDAY, NOVEMBER 2 , 2010 As CALLED BY
RESOLUTION 4282
VWHEREAS a General Municipal Election on November 2, 2010 has been called by
Resolution No. 4282, adopted on June 8, 2010; and
WHEREAS, the City Council also desires to submit to the voters at the election a
question relating to the City Cleric's position and a question relating to the City
Treasurers position.
NOW THEREFOREs BE IT RESOLVED, that the City Council of the City of Arroyo
Grande does resolve, declare, determine, and order as follows:
SECTION 1, That the City Council, pursuant to its right and authority, does order
submitted to the voters at the General Municipal Edon the folloydrig question:

SECTION 2. If the majority of the voters support this question, the City Clerk shall no
longer be an emotive official of the City of Arroyo Grande. From and after November 6,
2012, or upon earlier vacancy in the office of the City Cleric, the City Cleric shall be
appointed by the City Council. The City Clerk so appointed shall hold office at the
pleasure of the City Council acrd, notwithstanding California Government Code Section
36502 to the contrary, is not required to be a resident or elector in the City. The City
Council may by ordinance vest in the City M anager its authority to appoint the City
Clerk.

no longer be an elective official of the City of Arroyo Grande. From and after November
2012, or upon earlier vacancy in the office of the City Treasurer, the City Treasurer
shall be appointed by the City Council. The City Treasurer so appointed shall hold
office at the pleasure of the City Council and, notwth tending California Government
Code Section 36502 to the contrary, is not required to be a resident or elector in the
City. The City Council may by ordinance crest in the City Manager its authority to
appoint the City Treasurer.
SECTION 4 That in all particulars not recited in this resolution, the erection shall be
held and conducted as provided by law for holding municipal elections.
SECTION 5. That notice of the time and place of holding the election is given and the
City Clerk is authored, instructed and directed to give further or addrtionall notice of the
election, in time, form and manner as rewired by lair.
SECTION . That the City Clerk shall certify to the passage and adoption of this
Resolution and enter it into the book of original resolutions.

RECOMMENDATION:
It is recommended the Council approve the recommendation of Council Member Tim
Brown to appoint Lisa spear to the Planning Commission.
FINANCIAL IMPACT:
There is no fiscal impact from this action.
BACKGROUND:
O n January 14, 1997, the City Council adopted Ordinance No. 481 amending the
composition of applicable Commissions and Boards from seven to five members and
also adopted Resolution fro. 3192 establishing Council policy as it relates to the
appointment procedure to the Commissions, Boards and Committees. The Ordinance
states that the Mayor r and each respective member of the Council shall recommend a
representative to the various Commissions, Boards and Committees subject to the
approval by a majority vote of the Council. All Commission,, Board, and Committee
Members serge at the pleasure o the Council.
ANALYSIS OF ISSUES:
As a result of the election of Tim Brown to the City Council, there is now r n immediate
vacancy o n the Planning Commission. Pursuant to Council policy, Council Member
Brown is recommend the City Council a pprove the appointment of Lisa Spear t o
the Planning Commission for a four 4 year terra expiring January 31, 2015. An
application form for the recommended appointment is attached.

RECOMMENDATION:
It is recommended the City Council appoint Council Member Ray as the Mayor Pro Term
for the net one -year period.
FINANCIAL L IMPACT:
There is no cost impact from this action.
BACKGROUND:
At the December 10, 2002 meeting, the City Council established a policy regarding
selection of the Mayor Pro Tern. At that time, the City Council agreed to appoint the
Mayor Pro Tern on a one -year rotational basis by seniority. In Zoo, the policy was
modified to include additional language to address circumstances in which two
members have the same tenure on the City Council. if this situation exists, the order of
rotation is then based upon time served on a City Council appointed Commission and/or
Committee prior to being elected to the City Council.
The following provisions are set forth in the City Council operations Manual under
Policy 4. City Council Appointments:
A. The City Council appoints a Council Member as Mayor Pro Terms to serge the
duties o Mayor in his /her absence.
B. The Mayor Pro Tem shall serve a term of one }rear.
C. The appointment of the Mayor Pro Term takes place at the fiat meeting in
December of each year.
D. It is the City Council's policy to rotate appointment of the Mayor Pro Tern based
upon the seniority of City Council Members that have not yet served in the
position of Mayor Pro Term. If two Members of the City Council have the same
seniority, the order of rotation will be based upon time served o n e City Council
appointed Commission and/or Commi tee prig to being elected to the City
Council.

All Council Members, except Council Member Racy and newly elected Council Member
Brown, have previously served as May Pro Tern. Therefore, based on the rotation b
seniority, Council Member Ray would be the net in line for the position.
ADVANTAGES:
The current process provides an orderly and fair procedure for alternating the position of
Mayor Pro Tern. The proposed recommendations are consistent with the current policy.
DISADVANTAGES:
No disadvantages have been identified regarding this item.
ALTERNATIVES:
The following alternatives are provided for the Council's consideration:
1. Appoint Council Member Ray as the Mayor Pro Tern for the next one -year
period
2. Do not appoint Council Member Flay and modify the established policy;
