RESOLUTION NO. 2153
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ARROYO GRANOE
THAT A PUBLIC NUISANCE MAY EXIST
AT 421 WOOOLANO DRIVE
WHEREAS, the owners of the properties located on both sides of Arroyo
Grande Creek have permitted two trees to block the Arroyo Grande Creek
in the vicinity of 421 Woodland Drive; and
WHEREAS, the owners have not seen fit to remove the trees; and
WHEREAS, these conditions cause a potential for erosion problems
within the creek and as such are considered a public nuisance under Municipal
Code Section 4-9.01.
NOW, THEREFORE, BE IT RESOLVED that the City Council does find, based
on the recommendations of the Director of Public Works, that a Public Nuisance
may exist on the aforementioned properties commonly known as A.P.N. Numbers
6-391-21 and 6-561-20 also known as a Portion of lot 108 Ranchos Corral
De Piedra-Pismo and Bolsa De Chamisal, Lot 20 of Tract 260 (421 Woodland
Drive) .
BE IT FURTHER RESOLVED that in the event that finding that a Public
Nuisance exists, it will be the intent of the City Council to direct the
Director of Public Works to make appropriate recommendations for abating
the nuisance; and to employ a competent contractor to perform appropriate
work recommended, all at owner's expense.
BE IT FURTHER RESOLVED that the City Council has directed the City
Clerk to cause to be conspicuously posted on the premises a certified copy
of this Resolution, as well as a "Notice of Public Hearing"; and further
that at least fifteen (15) days before the Public Hearing, the City Clerk
shall cause to be served on the owner one copy of the "Notice of Public
Hearing" and a certified copy of this Resolution.
BE IT FURTHER RESOLVED that the date and time fixed for the Public
Hearing shall be on the 25th day of August, 1987, at 7:30 P.M, in the City
Council Chambers, 215 E. Branch Street, Arroyo Grande, at which time any
and all interested parties may testify and present evidence regarding this
matter.
On motion of Council Member Moots, seconded by Council Member
Porter, and on the following roll call vote, to wit:
AYES: Council Members Moots, Porter, Millis, Johnson and Mayor Mankin,;
NOES: None
ABSENT: None
the foregoing Resolution was passed and adopted this 25th day of August,
1987.
