RESOUITION NO. 1986
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARROYO GRANDE THAT A PUBLIC NUISANCE MAY EXIS'f AT
238 JAMES WAY
WHEREAS. the owner of the property located at 238 James Way has perfouned grading on this
property without a pemnt; and
WHEREAS. the owner has begun construction of Public l1qIrovements without an approved
plan; and
WHEREAS. these conditions may have caused a potential for erosion and dust control
problems.
NOW, 'niEREFORE, BE rr RESOLVED that the City Council does find, based on the
recomnendations of the Director of Public Works, that a I'mlic Nuisance may exist on the
aforementioned property, comnonly Imown as 238 James Way, Arroyo Grande, California, and IDDre
particularly described as a Portion of Lot 26, Rancho Corral De Piedra-PiSDIO Bolsa De Ownisal, R.M.
Bk. A, Page 63 in the Assessment roll of the County of San Luis Obispo.
BE rr FUR'niER RESOLVED that in the event that finding that a Public Nuisance exists, it
will be the intent of the City Council to dUect the Director of Public Works to eq>loy an independent
Civil Engineer to review the project; make appropriate reconmendations for abating the nuisance; and
to CIq1loy a cOJq>etent General Contractor to perform appropriate work reconmended by the Civil
Engineer, all at owner's e:l<pense.
BE rr FUR'niER RESOLVED that the City Council has dUected the City Clerk to cause to
be conspicuously posted on the premises a certified copy of this Resolution, as wen as a "Notice of
Public Hearing"; and, further, that at least fifteen (15) days before the Public Hearing, the City Clerk
shall cause to be served on the owner one copy of the "Notice of Public Hearing" and a certified copy
of this Resolution.
BE rr FURnIBR RESOLVED that the date and time fixed for the Public Hearing shall be on
the day of September 23, 1986, at 8:00 P.M., in the City Comcil Owubers at 215 E. Branch Street,
Arroyo Grande, at ..wch time any and all interested pa.tties may testify and present evidence regarding
this matter.
On IDDtion of Councilmember Gallagher, seconded by Councilmember Moots, and on the
following vote, to wit:
AYES: Mayor Smith and Councilmembers Gallagher, Johnson, Moots and Porter
NOES: NONE
ABSENT: NONE
the foregoing Resolution was passed and adopted this 26th day of August, 1986.
