R 3299 RESOLUTION NO. 3299 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE AUTHORIZING THE TEMPORARY CLOSURE OF THE SOUTH CUL-DE-SAC OF RUTH ANN WAY ON JULY 4, 1998 FOR A FOURTH OF JULY BLOCK PARTY WHEREAS, California Vehicle Code Section 21101 (e) authorizes municipalities the ability to require designation of any street temporarily closed for celebrations or other local special events or other purposes when in the opinion of the local authorities having jurisdiction such closing is necessary for the safety and protection of persons who are to use that portion of the street during the temporary closing and such closing must be adopted and provided for by resolution; and WHEREAS, Ms. Lori Chanley has requested that the south cul-de-sac of Ruth Ann Way be temporarily closed on Saturday, July 4, 1998, from 12:00 p.m. to 10:00 p.m., for the purpose of conducting a Fourth of July block party; and WHEREAS, the Department of Public Works, the Police Department, and the Fire Department have no objections, provided that emergency vehicle access will be readily available, if needed, during the temporary closure of the street; and WHEREAS, it is the opinion of the City Council of the City of Arroyo Grande that such block parties provide a form of neighborliness and facilitate understanding of problems within a neighborhood, and that such closure is necessary for the safety and protection of persons who are to use that portion of the street during the temporary closing for the block party. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arroyo Grande that: . Section 1. The temporary closing of the south cul-de-sac of Ruth Ann Way on Saturday, July 4,1998, from 12:00 p.m. to 10:00 p.m., for the purpose of conducting a Fourth of July block party is hereby authorized. Section 2. All individuals participating in the block party are required to erect suitable barriers (lighted after dark) across the entrance to the south cul-de-sac of Ruth Ann Way giving due consideration to the motoring public and the movement of emergency vehicles in the area, subject to approval of the Chief of Police. Said barriers shall be promptly removed a~ 10:00 p.m. on July 4, 1998. Section 3. No loud or .elevated music or other noise that would create a disturbance shall be permitted. Section 4. Per Arroyo Grande Municipal Code, no alcoholic beverages shall be consumed on City streets or sidewalks. RESOLUTION NO. 3299 Page 2 Section 5. The City Clerk shall certify to the adoption of ,this resolution and shall cause a certified resolution to be filed in the Office of the City Clerk. On motion of Council Member.
