CC 2018-07-24_09c Side Letter of Agreement_POA MEMORANDUM TO: CITY COUNCIL FROM: DEBBIE MALICOAT, DIRECTOR OF ADMINISTRATIVE SERVICES SUBJECT: CONSIDERATION OF A SIDE LETTER OF AGREEMENT TO THE ARROYO GRANDE POLICE OFFICERS’ ASSOCIATION MEMORANDUM OF UNDERSTANDING DATE: JULY 24, 2018 SUMMARY OF ACTION: Approving the Side Letter of Agreement with the Arroyo Grande Police Officers’ Association (AGPOA) will provide an updated list of classifications represented by the AGPOA. IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: Elimination of the Property and Evidence Technician position and creation of the position of Police Records/Property and Evidence Clerk will save $109,000 annually. These savings were anticipated when the current fiscal year budget was developed. RECOMMENDATION: It is recommended the City Council adopt a Resolution approving a side letter of agreement to the Arroyo Grande Police Officers’ Association Memorandum of Understanding. BACKGROUND: As part of the FY 2018-20 Biennial Budget, the City eliminated a full-time Property and Evidence Technician position in the Police Department with the expectation that these duties would be reassigned to existing staff, reduced, and/or eliminated. Many of the responsibilities for the property and evidence functions have been reassigned to a new Police Records/Property and Evidence Clerk position. Item 9.c. - Page 1 CITY COUNCIL CONSIDERATION OF A SIDE LETTER OF AGREEMENT TO THE ARROYO GRANDE POLICE OFFICERS’ ASSOCIATION MEMORANDUM OF UNDERSTANDING JULY 24, 2018 PAGE 2 ANALYSIS OF ISSUES: The City’s Administrative Services Director and Human Resources Manager met and conferred with the AGPOA, which represents both the Records Clerk and the Property and Evidence Technician classifications. Those discussions resulted in agreement on the new job description and salary range for the new position. It is recommended that the new position be paid at the same salary range as the previous Property and Evidence Technician position; however, it will also continue to have responsibility for records functions and duties. City staff and AGPOA have agreed that the current Memorandum of Understanding (MOU), which expires June 30, 2020, should be modified to reflect the following changes: 1. Elimination of the Property and Evidence Technician classification. 2. Adding the Police Records/Property and Evidence Clerk classification to the list of positions represented by AGPOA with salary schedule 22. 3. Updating the salary schedules at the back of the MOU with these changes. The mechanism to affect a Memorandum of Understanding before it is expired is a “side letter agreement” to the MOU, which is attached as Exhibit A to the accompanying Resolution. ALTERNATIVES: The following action is provided for City Council consideration: 1. Adopt a Resolution approving a side letter of agreement to the Arroyo Grande Police Officers’ Association Memorandum of Understanding. 2. Revise and adopt a Resolution approving a side letter of agreement to the Arroyo Grande Police Officers’ Association Memorandum of Understanding. 3. Provide further direction to staff. ADVANTAGES: The recommendation will provide a Memorandum of Understanding that reflects the most current job classifications and salary ranges for all positions represented by the AGPOA. DISADVANTAGES: There are no significant disadvantages to the recommended action. ENVIROMENTAL REVIEW: No environmental review is required for this item. PUBLIC NOTIFICATION AND COMMENTS: The Agenda was posted at City Hall and on the City’s website in accordance with Government Code Section 54954.2. Item 9.c. - Page 2 RESOLUTION NO. A RESOLUTION OF THE CITY OF ARROYO GRANDE APPROVING A SIDE LETTER OF AGREEMENT TO THE ARROYO GRANDE POLICE OFFICERS’ ASSOCIATION MEMORANDUM OF UNDERSTANDING WHEREAS, the City Council of the City of Arroyo Grande (“City”) deems it in the best interest of the City to approve a side letter of agreement amending the Arroyo Grande Police Officers’ Association current Memorandum of Understanding, which includes modifications to represented classifications, as hereinafter provided. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arroyo Grande that: 1. An amendment to the Memorandum of Understanding (“MOU”) with the Arroyo Grande Police Officers’ Association (“AGPOA”) is hereby approved, a copy of said amendment entitled “Side Letter of Agreement, Modification to Memorandum of Understanding” is attached hereto, marked Exhibit “A”, and incorporated herein by this reference. 2. This Resolution shall become effective July 13, 2018. WHITHAM, CITY ATTORNEY Item 9.c. - Page 4 EXHIBIT A SIDE LETTER OF AGREEMENT MODIFICATION TO MEMORANDUM OF UNDERSTANDING For valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the City of Arroyo Grande (“City”) and the Arroyo Grande Police Officers’ Association (“AGPOA”) do hereby agree to modify the current Memorandum of Understanding (“MOU”) between the City and AGPOA as follows: ARTICLE 2. SALARY SCHEDULES The City and AGPOA agree to modify the classifications and salary ranges to read: CLASSIFICATION SALARY RANGE Police Sergeant 41 Senior Police Officer 35 Police Officer 31 Police Trainee 27 (Non-Sworn) Police Records/Property and Evidence Clerk 22 (Non-Sworn) Police Records Clerk 18 (Non-Sworn) Exhibit “F” and Exhibit “H” to the MOU shall be modified to include the Police Records/Property and Evidence Clerk and eliminate the Property Evidence Technician classifications.
