RESOLUTION NO. 1901
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ARROYO GRANDE APPROVING USE PERMIT
CASE NO. 85-397, APPLIED FOR FILER CON.
STRUCTION COMPANY FOR A RESTAURANT ON WEST
BRANCH STREET IN THE "P.D" DISTRICT, SUBJECT
TO CERTAIN CONDITIONS
WHEREAS, the Planning Commission of the City of Arroyo Grande has
considered an application of Filer Construction Company for construction of
a restaurant on West Branch Street; and
WHEREAS, the Commission found that, after due study, deli berat i on and
public hearing, the following circumstances exist:
1. Consistent with the General Plan
2. Consistent with provisions of the Zoning Ordinance
3. Project has been reviewed by the Staff Advisory Committee
4. Will have no adverse affect on the surrounding area
WHEREAS, THE City Counc il has considered an appl ication of Filer
Construction Company for construction of a restaurant on West Branch Street;
and
WHEREAS, the City Council found that, after due study, deliberation and
public hearing, that the findings of the Planning Commission were consistent
with City policy.
NOW, THEREFORE, BE IT RESOLVED that the City Counc il of the City of
Arroyo Grande hereby approves said Use Permit subject to the Standard
Conditions, and the following special conditions
1. Landscaping plan to be submitted to the Parks and Recreation Director
for approval prior to issuance of a building permit. Said landscaping plan
to include the eastern slope above the property.
2. A gradi ng and eros i on plan shall be submitted for approval by the
Public Works Director prior to issuance of a building permit.
3. A drainage plan shall be submitted for approval by the Public Works
Director prior to issuance of a building permit.
4. A water and sewer plan shall be submitted for approval by the Public
Works Director prior to issuance of a building permit.
5. Install automatic fire sprinklers as per N.F.P.A. 13.
6. Maintain 24 foot minimum access after parking.
7. Install a new fi re hydrant at entrance to development ( site to be
specified by Fire Department).
On motion of Counc i 1 Member Gallagher, seconded by Counci 1 Member
Johnson, and by the following roll call vote, to wit:
AYES: Council Members Gallagher, Johnson, Porter and Mayor Smith
NOES: None
ABSENT: None
the foregoing Resolution was passed and adopted this 22nd day of October,
