I RESOLUTION NO. 1893
A RESOLUTION OF INTENTION TO ABATE A
I PUBLIC NUISANCE AT 134 NELSON STREET,
I UNDER THE PROVISIONS OF ORDINANCE
NO. 309 C.S.
( WHEREAS, certain provisions of the City's Comprehensive Zoning Ordinance
have been violated at 134 Nelson Street; and
WHEREAS, certain violations of the Zoning Ordinance and 'City Building
Code have been reported; and
WHEREAS, written notices of these violations have been given on June
27, 1985 and September 3, 1985; and
WHEREAS, no visible action has been taken to mitigate the above referenced
violations.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Arroyo
Grande as follows:
1. It is the intention of the City Council of the City of Arroyo
Grande to hold a public hearing concerning the
existence of a possib1e public nuisance at 134 Nelson Street,
(old 'Wood-Voakes Mortuary) consisting of numerous violations
of the City's zoning, building, electrical, plumbing, fire and
. health codes resulting from illegal remodeling, occupancy,
parking and other land use changes without proper permits.
[ 2. Said public hearing is hereby scheduled for November 27, 1985,
- at 1 p.m., in the Council Chambers.
3. Notice of the public hearing shall be given as required by law.
4. In addition, a copy of this Resolution shall be sent by
certified mail to all owners and lienholders of record
for said property, and to all tenants on the premises.
Personal delivery may be substituted for certified mail at the
option of the City Clerk.
5. If said nuisance is not completely and satisfactorily
corrected before the scheduled hearing time, and if the
Council finds; after the public hearing, that a public
nuisance exists, the Council may then order that the
nuisance be abated within a specified time by rehabilitation,
repair, demolition, removal, including removal of tenants,
or other appropriate actions, all at the expense of the property
owner, and with a lien against the property for all costs
incurred by the City, as provided by City Ordinance.
On motion by Council Member Johnson, seconded by Council Member
Gallagher, and on the following roll call vote, to wit:

NOES: None
ABSENT: Council Member Moots
the foregoing Resolution was passed and adopted this 22nd day of October,
1985.
