SmokingActivity Prohibition in Public Areas cc mt SUMMARY OF THE LAW • While Arroyo Grande has established laws for tobacco free zones in certain public areas, I propose that all public areas of Arroyo Grande should be tobacco free. These public areas should include: dining establishments, entryways,public events, recreation areas,service areas, sidewalks and work sites. Tobacco activity, including cigarettes,cigars,e-cigarettes, and vaping, in Arroyo Grande should be limited to people smoking only on their private property.The reason for this proposal is to protect-people's health, protect our air quality, diminish tobacco-product butt litter, protect public areas from smoking related fires, and protect the land, oceans,and sea life from tobacco-product butt toxins. WHY IT IS NEEDED • Arroyo Grande is a town that people come to live in and visit from all over the world.We all enjoy Arroyo Grande because of its small town charm, central coast location, and beauty. Smoking in the public areas of Arroyo Grande takes away from its beauty for many reasons. It causes litter, it smells bad, it pollutes the air, and it raises the risk of fires.Smoking in public places in • Arroyo Grande also puts people's health at risk because they are forced to breath secondhand smoke, according to the American Lung Association. • People walking on the streets or sidewalks won't have to unintentionally inhale secondhand smoke from other people against their will. Secondhand smoking is especially unsafe for children and babies because that's the time when their bodies and lungs are still developing and it would be a serious problem if they get exposed to smoke at a young age, according to the ASCO Foundation. • Tobacco-product butt litter reduction keeps our streets cleaner,reduces the risk of fires, and reduces the risk of them traveling down our storm drains and into the ocean where their toxins put marine life at risk, according to the Earth Resource Foundation. BACKGROUND • Smoking in public areas is a problem because people are forced to unintentionally inhale secondhand smoke.The American Lung Association, as well as other sources, state that secondhand smoke is extremely dangerous and puts people at risk for lung disease, heart disease, and cancer. Other sources, such as the ASCO Foundation, state that secondhand smoke is especially dangerous around young children because their bodies and lungs are still in development at that time. Secondhand smoke is also a public nuisance for people to smell when they are trying to enjoy the clean outdoor air. • Another problem associated with public smoking is the litter it generates. Many smokers litter tobacco product butts instead of throwing them away properly in trash cans. It has been reported by the BMJ Publishing Group that cigarette butts are the #1 most common littered object in the world and about 4.5 trillion cigarette butts are littered worldwide each year. Not only is this not pleasant to look at, it also isn't eco-friendly.Toxins from cigarette butts affect the land, ocean and sea life. Cigarette butts discarded in parking lots, along sidewalks, and in street gutters miles from the coast inevitably make their way through the storm drains, creeks, and rivers to the beach and the ocean.Tobacco-product butts are also a fire hazard when they are littered and not properly extinguished. It has been reported by UC Davis that smoking causes an estimated 30 percent of fire deaths in the United States and 10 percent of fire deaths worldwide. • The American Lung Association's document,The State of Tobacco Control, has issued grades for Smoke-Free Outdoor Air in several locations in San Luis Obispo County for 2018.Arroyo Grande received the grade of a"D". Morro Bay received an"A", Paso Robles received a"B", and San Luis Obispo also received an"A". The reason that Arroyo Grande has a much lower grade . for their Smoke-Free Outdoor Air is because Morro Bay, Paso Robles, and San Luis Obispo have laws for more tobacco-free areas in outdoor places than Arroyo Grande does. • In March of 2017, Paso Robles made the following areas tobacco-free: city buildings, enclosed public places, outdoor events, city parks,trails, sports facilities, common areas of multi-unit residential buildings, and within 20 feet of an entrance or exit of commercial buildings. In May of 2012, Morro Bay expanded their tobacco-free areas to include areas within 20 feet of entrance ways,vents, and other places tobacco smoke could enter enclosed places. In May of 2010, San Luis Obispo included ' sidewalks, parking garages,bars, restaurants, stores, stadiums, playgrounds, and transit centers to become tobacco-free. 4cp CENTRAL COAST *AP NEW TECH HIGH SmokingActivity Prohibition in Public Areas RELATED LEGISLATION • Paso Robles,Chapter 9.41.030 Smoking Prohibited in Public o Smoking shall be prohibited in the following places:. • Within all city-owned, leased, or operated buildings, including meeting facilities and the library conference room/city council chamber; • Within all places of employment, in accordance with California Labor Code Section 6404.5, as may be amended; • Within all enclosed places,whether publicly-or privately-owned and regardless of any applicable fee or age requirement,that are available and open to the general public, including but not limited to parking garages, bars,restaurants, cafes, outdoor dining patios or courtyards, clubs, stores, arenas,taxis and buses; • At all outdoor public events, including but not limited to sports events,speaking performances, ceremonies, pageants,fairs, and other entertainment events open to the public; • In or upon any city park or playground, city sports facility, or city trail area; • Within twenty feet of the entrance or exit of any commercial establishment open to the general public; ■ In common areas of multi-unit residential buildings, including halls, lobbies, outdoor eating areas, play and swimming areas. • Morro Bay,Chapter 9.24.040 Public and other places where smoking is prohibited o Except as otherwise provided by this chapter or by state or federal law, smoking shall be prohibited everywhere in the city, including but not limited to: ■ All public places; • Residences used as child care, health care, board and care, or community foster care facility as such terms are defined by state Health and Safety Code; • Places of employment, except outdoor construction sites; • Enclosed and unenclosed places of hotels, businesses, restaurants, bars and other public accommodations; • Any means of public transit including associated waiting areas, and service areas, enclosed or not. • San Luis Obispo,Chapter 8.16.040 Prohibition of smoking and tobacco products in outdoor recreational areas o A. Smoking and all forms of tobacco products shall be prohibited in the following places: is 1. In any city park and all its amenities, parking areas,trails, and walkways, including contiguous sidewalks. • 2. In all city open spaces and ecological areas and all appurtenant trail systems, parking areas, and other amenities. • 3. In all city sports facilities, including: • a.The municipal golf course; • b.The San Luis Obispo Swim Center; • c. Skate park; • d. Roller hockey rink; • e.All sports fields. • 4. In all city dog parks. ■ 5. In all public transportation facilities including all bus shelters and bus stops. • 6. In Mission Plaza and the adjacent creek walk from Mission Plaza to Nipomo Street. o B. Other local cities like Atascadero and Pismo Beach have passed similar ordinances prohibiting smoking at public parks,state beaches and the Charles Paddock Zoo. Statewide, large population centers such as Santa Monica and Pasadena have banned smoking in all outdoor areas that includes events like Farmers Market and the Rose Parade." (San Luis Obispo Municipal Code Section 8.16.030;Atascadero Municipal Code 10-1.34; Pismo Beach Ordinance NO.2007-002, Chapter 8.14.010; Santa Monica Municipal Code Chapter 4.44.010; Pasadena Municipal Code Section 8.78.085) • San Luis Obispo-The Tribune: o "The Paso Robles City Council took final action Tuesday to adopt an ordinance banning tobacco and marijuana smoking in public places around the city.The law takes effect 30 days after the council vote,which would be March 23.The council unanimously approved a first reading of the ordinance two weeks ago. Under the new law,tobacco use— including cigarettes,e-cigarettes, cigars and pipes—and marijuana smoking aren't allowed in city buildings and enclosed public places; at outdoor events and city parks,trails and sports facilities;or in common areas of multi unit residential buildings.Tobacco smokers must stay at least 20 feet away from the entrance or exit of any commercial establishment. In addition,the law bans marijuana smoking on city property including streets, sidewalks,trails, bike paths, alleys,highways and parking lots." o Stopping short of the outright ban that was originally proposed,the Morro Bay City Council on Tuesday voted to forbid smoking within 20 feet of entrance ways,vents and other places where smoke could enter an enclosed area.The rules also allow for the establishment of smokers' outposts, designated outdoor areas where smoking would be allowed.
