WHEREAS, the City Council of the City of Arroyo Grande has adopted a
resolution declaring its intent to hold a pIDJ.ic hearing to ascertain whether
a public nuisance exists at the property located at 704 Branch Mill Road,
being a portion of Lots 89 and 91 of the Ranchos Corral de Piedra, PiSIOO and
Iblsa de Cbamisal, according to the Map filed in Book A, Page 65, Office of
the County Recorder of San Luis Cbispo County, state of California (AKA APN
No. 7-621-32); and
WHEREAS, said public hearing was held at the regular meeting of January
8, 1985; and
WHEREAS, testim:>ny was taken from the public and the City staff; and
WHEREAS, it is necessary to resolve the following matter as expeditously
as possible due to current rainy season:
Existing slopes adjacent to the drainage swale do not meet
standard 2 to 1 gradients. '1here is a potential for sluffing
of the graded fill into the drainage ditch resulting in the
possibility of tenp>rary flooding in the area.
lO'l, 'mEREFORE, BE IT RESOLVED that it is the finding of the City Council
of the City of Arroyo Grande that pIDJ.ic nuisance exists as described above
and said nuisance shall be abated within 30 days after adoption of this
resolution; and
BE IT FlJKJ.ma< RESOLVED that the City Clerk is directed hereby to serve
upon the owners of the aforementioned property in accordance with Ordinance
No. 309 C. S., a copy of this resolution; and
BE IT INKLma< RESOLVED that in the event abatement has not been coopleted
in full by the owner, it is the intent of the City Council to direct the
Director of Public Works to abate said nuisance and assess the costs thereof
to the owner of said property.
