RESOLUTION NO. 1818
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ARROYO GRANDE DECLARING ITS INTENT TO HOLD
A PUBLIC HEARING TO ASCERTAIN WHETHER A PUBLIC
NUISANCE EXISTS AT PROPERTY LOCATED AT
704 BRANCH MILL ROAD (AKA APN 7-621-32)
MILT HAYES, et ux
WHEREAS, the owner of the property located at 704 Branch Mill Road,
(AKA APN 7-621-32) has been issued two conditional grading permits; and
WHEREAS, certain conditions attached to said grading permits have not been
complied with; and
WHEREAS, members of the Public Works and Building Department Staffs have
met with the Owner of said property regarding this matter on several occasions;
and
WHEREAS, a letter dated November 13, 1984, specifically outlining concerns
of the Public Works Director regarding the grading on the referenced site has
been appropriately addressed to Mr. Hayes with a copy to his Engineer, San Luis
Engineering; and
WHEREAS, the concerns outlined by the Public Works Director in said 11/13/84
letter have not been addressed by the Owner prior to the November 30, 1984 deadline
established by the Director of Public Works; and
WHEREAS, the City Council has received two letters of concern regarding the
project from Michael Zimmerman, Attorney for John Lowrey, 544 Los Olivos Lane,
Arroyo Grande;
NOW, THEREFORE, BE IT RESOLVED that the City Council does find, based on the
recommendations of the Director of Public Works, that a Public Nuisance may exist
on the aforementioned property commonly known as 704 Branch Mill Road, Arroyo
Grande, CA, being a portion of Lots 89 and 91 of the Ranchos Corral de Piedra,
Pismo and Bolsa de Chamisal, according to Map filed in Book A, Page 65, Office
of County Recorder of San Luis Obispo County, State of California (AKA APN 7-621-32).
BE IT FURTHER RESOLVED that in the event that finding that Public Nuisance
exists it will be the intent of the City Council to direct the Director of Public
Works to employ an independent Civil Engineer to review the project; make appro-
priate recommendations for abating the nuisance; and to employ a competent General
Contractor to perform appropriate work recommended by the Civil Engineer, all at
Owner's expense;
BE IT FURTHER RESOLVED that the City Council has directed the City Clerk to
cause to be conspicuously posted on the premises a certified copy of this
Resolution,as well as a "NOTICE OF PUBLIC HEARING"; and further that at least
fifteen (15) days before the Public Hearing, the City Clerk shall cause to be
served on the Owner one copy of the Notice of Public Hearing and a Certified copy
of this Resolution.
BE IT FURTHER RESOLVED that the date and time fixed for the Public Hearing
shall be on the 8th day of January 1985, at 8:00 P.M., in the City Council Chambers
at 215 East Branch Street, Arroyo Grande, at which time any and all interested
parties may testify and present evidence regarding this matter.
On motion of Council Member Gallagher, seconded by Council Member Johnson,
and on the following roll call vote, to wit:
AYES: Council Members Gallagher, Johnson, Porter and Mayor Smith
NOES: None
ABSENT: None
the foregoing Resolution was passed and adopted the 11th day of December 1984.
