CC 2019-08-13_08g Acceptance of Public Improvements_Tract 3054 Oak Arbors MEMORANDUM TO: CITY COUNCIL FROM: TERESA MCCLISH, COMMUNITY DEVELOPMENT DIRECTOR BILL ROBESON, PUBLIC WORKS DIRECTOR BY: ROBIN DICKERSON, CITY ENGINEER SUBJECT: CONSIDERATION OF A RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS FOR TRACT 3054 - OAK ARBORS - BY S&S HOMES DATE: AUGUST 13, 2019 SUMMARY OF ACTION: Accepting easements and public improvements for Tract 3054 allows the City to release the bonds and start the one-year warranty period. IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: As previously approved, the maintenance of the new public improvements will add to the overall costs of the City infrastructure maintenance program. RECOMMENDATION: It is recommended the City Council adopt a Resolution accepting easements and public improvements for Tract 3054. BACKGROUND: The project site is approximately 2.15 acres in size, zoned Single Family Residential (SF) and is comprised of two (2) parcels, one with an existing residence. The project site is surrounded on all sides by single family residential use, is fairly flat, contains approximately 20 oak trees and a 240’ long row of eucalyptus trees. The neighborhood is characterized by the presence of large oak trees located throughout neighboring lots. The Planning Commission approved Tract 3054, consisting of seven (7) residential lots, on May 5, 2015. The Final Tract Map 3054 was recorded on June 6, 2016. ANALYSIS OF ISSUES: The improvement plans were approved in April 26, 2016. The improvements were completed by the developer in June 2019. The City Engineer inspected the improvements and found them to be in substantial conformance to the approved plans on July 2, 2019. “As-built” improvement plans were submitted to the City on June 20, 2019. Operation and Maintenance Agreements have been recorded for all 7 lots in accordance with City Municipal Code 13.24.110. Item 8.g. - Page 1 CITY COUNCIL CONSIDERATION OF A RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS FOR TRACT 3054 AUGUST 13, 2019 PAGE 2 ALTERNATIVES: The following alternatives are provided for the Council's consideration: 1. Approve staff’s recommendation; 2. Do not approve staff’s recommendation; 3. Modify as appropriate and approve staff’s recommendation; or 4. Provide direction to staff. ADVANTAGES: The acceptance of public improvements is required to release bonds. DISADVANTAGES: No disadvantages have been identified. ENVIRONMENTAL REVIEW: A Mitigated Negative Declaration was adopted by the Planning Commission on May 5, 2015, in compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines and the City of Arroyo Grande Rules and Procedures for implementation of CEQA. PUBLIC NOTIFICATION AND COMMENTS: The Agenda was posted at City Hall and on the City’s website in accordance with Government Code Section 54954.2. At the time of report publication, no comments have been received. Item 8.g. - Page 2 RESOLUTION NO. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE ACCEPTING PUBLIC IMPROVEMENTS FOR TRACT 3054 - ARBOR OAKS - CONSTRUCTED BY S&S HOMES WHEREAS, Arroyo Grande Planning Commission approved Vesting Tentative Tract Map 3054 on May 5, 2015; and WHEREAS, the project was conditioned to complete certain public improvements pursuant to Planning Commission Resolution No. 15-2224 adopted by the Arroyo Grande Planning Commission on May 5, 2015; and WHEREAS, the Final Tract Map 3054 was recorded on June 6, 2016 with the San Luis Obispo County Recorder’s Office; and WHEREAS, the developer constructed the improvements required by the conditions of approval for Tract 3054 in June 2019; and WHEREAS, staff has inspected the improvements on July 2, 2019 and find they are constructed in accordance with the approved plans for the project. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Arroyo Grande hereby accepts public improvements for Tract 3054 including public curb, gutter, sidewalk on Ash Street, water lines, and sewer lines.
