R 1729 ( .~ - RESOLUTI ON NO. 1729 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE APPROVING A USE PERMIT, CASE NO. 83-352 APPLIED FOR BY E-Z 8 MOTEL, INC. FOR A 99 ROOM MOTEL WITH LIVING QUARTERS FOR MANAGEMENT, AND A SIGN RELATING TO THE MOTEL, IN A "P-D" ZONE, SUBJECT TO CERTAIN CONDITIONS. WHEREAS, the Planning Commission of the City of Arroyo Grande has considered an application for a Use Permit permitting a 99 room motel and a sign for said motel; and WHEREAS, following a public hearing the Planning Commission recommended to the City Council approval with conditions of said motel and sign; and WHEREAS, the City Council held a public hearing on the referenced Use Permit application; and WHEREAS, following said public hearing the City Council did approve the requested Use Permit for a motel and sign, subject to conditions, based upon findings that: I. The request was consistent with the General Plan. 2. The request was consistent with the provisions of Ordinance No. 140 C.S. 3. The request was consistent with environmental considerations and mitigations set forth in E.I.R. Oak Park Acres as certified by the City Council in 1976. 4. The request is consistent with design considerations for the Oak Park area and with the surrounding commercial development. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Arroyo Grande hereby approves said Use Permit, subject to the Standard Conditions of the City, and the following special conditIons: 1. The provisions of Ordinance No. 140 C.S. as adopted. 2. The location of hydrants with required fire flows, fire alarm system and portable extinguishers, subject to the approval of the Fire Department prior to issuance of permits. 3. A parking lot lighting plan to be approved by the Police Department prior to issuance of permits. 4. A landscape plan, including types, sizes and locations of materials to be approved prior to issuance of permits. 5. A sign, not to exceed 300 sq. ft. in sign face area and not exceeding 30 ft. in height shall be permitted subject to the submission of plans and approval by the Planning Director. 6. Developer volunteers and City shall accept $15,000.00 to be used by City for road improvements on that section of West Branch Street between Brisco Road and the end of paving built by Festival Cinema. At this writing, Staff anticipates improvements in that location of West Branch Street wil! be completed with proposed Assessment District 81-1. In the event the District is not formed by June 30, 1985, or the roadway is not otherwise improved in that location by June 30, 1985, the aforementioned funds will be returned to the original contributor.
