CC 2019-12-10_08f Accepting Public Improvements_Agrarian Hotel MEMORANDUM TO: CITY COUNCIL FROM: BILL ROBESON, PUBLIC WORKS DIRECTOR BY: ROBIN DICKERSON, CITY ENGINEER PATRICK HOLUB, PERMIT TECHNICIAN SUBJECT: CONSIDERATION OF A RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS AND A PUBLIC PEDESTRIAN ACCESS EASEMENT DEED FOR THE AGRARIAN HOTEL LOCATED AT 325 EAST BRANCH STREET DATE: DECEMBER 10, 2019 SUMMARY OF ACTION: Acceptance of the public improvements and a public pedestrian access easement deed for The Agrarian Hotel. IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: Maintenance of the new public improvements will add to the overall costs of the City infrastructure maintenance program. RECOMMENDATION: It is recommended the City Council adopt a Resolution accepting public improvements and a public pedestrian access easement deed for The Agrarian Hotel. BACKGROUND: The project site is 1.86 acres in size and is zoned Village Mixed Use (VMU). The project is adjacent to Tally Ho Creek to the east. The project site is surrounded on all sides by commercial uses, with some residential properties to the northwest. The Planning Commission approved Conditional Use Permit (CUP) 15-007, allowing the construction of a 54 room boutique hotel and adopted a Mitigated Negative Declaration (MND) on February 16, 2016. ANALYSIS OF ISSUES: The improvement plans were approved on May 17, 2017. The improvements were completed by the developer in May 2019. The City Engineer inspected the improvements and found them to be in substantial conformance to the approved plans on May 6, 2019. “As-built” improvement plans were approved by the City on September 13, 2019. An Operation and Maintenance Agreement has been recorded in accordance with City Item 8.f. - Page 1 CITY COUNCIL CONSIDERATION OF A RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS AND EASEMENT FOR THE AGRARIAN HOTEL DECEMBER 10, 2019 PAGE 2 Municipal Code Section 13.24.110. The public improvements include the following:  Portion of the 8” sewer main and manhole  Fire water lines and fire hydrant  Curb, gutter and sidewalk on Le Point Street  Pedestrian sidewalk from E Branch Street to Le Point Street The conditions of approval for Conditional Use Permit 15-007 also requires a pedestrian access easement. The developer has executed the easement, which requires the City Council’s acceptance before it can be recorded. ALTERNATIVES: The following alternatives are provided for the Council's consideration: 1. Approve staff’s recommendation; 2. Do not approve staff’s recommendation; 3. Modify as appropriate and approve staff’s recommendation; or 4. Provide direction to staff. ADVANTAGES: By accepting the public improvements, the City will have ownership of facilities in the public right of way and within the easement. DISADVANTAGES: No disadvantages have been identified. ENVIRONMENTAL REVIEW: Planning Commission reviewed this project in compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines and the City of Arroyo Grande Rules and Procedures for implementation of CEQA and adopted a Mitigated Negative Declaration on February 16, 2016. PUBLIC NOTIFICATION AND COMMENTS: The Agenda was posted at City Hall and on the City’s website in accordance with Government Code Section 54954.2. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE ACCEPTING PUBLIC IMPROVEMENTS AND A PUBLIC PEDESTRIAN ACCESS EASEMENT DEED FOR THE AGRARIAN HOTEL, LOCATED AT 325 EAST BRANCH STREET WHEREAS, the Planning Commission approved Conditional Use Permit 15-007 on February 16, 2016; and WHEREAS, the project was conditioned to complete certain public improvements pursuant to Planning Commission Resolution No. 16-2244 adopted by the Planning Commission on February 16, 2016; and WHEREAS, the developer has constructed the improvements required by the conditions of approval for Conditional Use Permit 15-007 in May 2019; and WHEREAS, staff inspected the improvements on May 6, 2019 and find they are constructed in accordance with the approved plans for the project; and WHEREAS, the developer has provided a pedestrian access easement deed to the City for the sidewalk that connects E. Branch Street to Le Point Street. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Arroyo Grande hereby accepts the public improvements and pedestrian access easement deed for The Agrarian Hotel, located at 325 East Branch Street, including public curb, gutter, sidewalk on Le Point Street., fire water lines, fire hydrant, sewer lines, sidewalk within the pedestrian pathway and a pedestrian easement for the creek-side pathway.
